Four months after the purchase, Twiss had cleared five acres and built a ten stall barn. Since that time, Twiss has finished construction of her home, cleared another 15 acres and added an arena to the property.
Twiss recently learned that her business, which specializes in the retraining of thoroughbred race horses, is not allowed under residential zoning. To bring her business into compliance, Twiss appeared before the planning commission Thursday to request that her acreage be rezoned to agricultural.
Her neighbor, Karen Post, spoke in opposition of the proposed rezoning.
Post said their neighborhood, Riverbluff subdivision, is a residential area and that agricultural activities would have a negative impact on her property values.
“We expected to enjoy residential activities,” she said. “We never would have bought R-1 land next to agricultural property.”
Post claimed that Twiss is in violation of several zoning ordinances and that code enforcement has not been responsive to her concerns. Post also voiced concerns about having horses adjacent to her property.
“The danger of these unpredictable, large animals next to our house in unacceptable,” she said.
Post asked the planning commission to deny the rezone request claiming that her property has already been devalued and that the entire subdivision would be impacted.
“Who is going to buy our residential lot at full value with agricultural adjacent to it?” a tearful Post asked.
Twiss said Post is wrong about the impact of the stables on property values.
“When we bought the property, there were only three people in the area that had horses,” Twiss said. “Now, it’s fast becoming an equestrian enclave in Barrow County.”
Twiss likened the property to similar areas in Alpharetta which she said have only increased in value.
The commission approved Twiss’ request by a vote of 3-0.
In other business, the commission:
• approved a request to rezone 8.54 acres in the area of Rat Kinney Road and Hollis Road from AG to AR for a minor subdivision.
• approved a request to split 5.74 acres on Dooley Town Road into three tracts and rezone the property from AG to AR and R1.
• approved a request to rezone 2.82 acres from AR to R1 and split the land into two tracts.
• approved a correction to the Barrow County zoning map for property located on Jackson Trail Road. The correction will change the property zoning from AG to M1.
The rezone requests will go before the Barrow County Board of Commissioners on September 23. The board will meet at 7 p.m. in the board room of the Barrow County Administration Building located at 233 East Broad Street in Winder.
The only reason, I'm rezoning is because my neighbors, Karen and Kenny Post didn't do their homework before purchasing the 5 acres adjacent to mine. They suddenly realized they couldn't build their "$150,000" house where they wanted because of a preexisting barn. Their property isn't wide enough to cover the required setback. So they complained to the county thinking they would make me tear it down. It's preexisting!!!
Even if the barn wasn't there, they couldn't put a septic tank in the proposed build site because of the water table -- it wouldn't pass the perk test. It would be very expensive to install the pumping system needed to carry waste to the existing septic tank.
When Karen and Kenny realized that the county didn't see things their way, and wasn't going to make me tear down my barn, they filed a frivolous and unfounded complaint with the EPD (Environmental Protection Division)that I was dumping horse poop in the river.
You can't chose your neighbor's -- you just have to deal with them.
The manure goes into two piles, both of which are EXTREMELY small piles. Gardeners come twice a year and clean out the compost piles.
Both piles are as far from the river as possible. Nor are they near any natural water source, course or stream.
We also use a pelletized bedding in the stalls. This absorbs four times its weight in water (or any liquid). In addition, we use the Brookwood Stall Shifter. This reduces the amount of bedding being throw out and thus reduces the amount of muck needing to be composted.
We're also in the process of installing an O2Composter (aerated composting) unit. By doing this, instead of giving away our compost, we can now bag it, and sell it as organic compost. It becomes an additional income stream.
1-she has no issue with the garden. In fact, she loves the fresh vegetables that she is allowed to harvest.
2-Horses can be scary to people who are not familiar with them. More than that, sitting on your porch with a soothing cup of tea is no fun when you are surrounded by flies and horse flies. Those things hurt like hell when they get you.
3- Being a considerate and responsible neighbor requires that you communicate with your neighbors. It is okay for a person to request and expect certain things of their neighbors. I think it is healthy to communicate especially when the actions of one affect so many others. How would Mrs. Twiss like it if she was in the middle of training and had some loud ass idiots screaming around her property on motorcycles that have the boar wide open? Having had horses all my life, the fear of a spooked horse is absolutely real. I bet you ten to one if those motorcycles disturbed Mrs. Twiss while, conducting a lesson, she would be first in line to complain

me how horse poop could possibly contaminate streams and
creeks. Has it ever occurred to you that most all pastures
have a creek or stream for water sources for cattle. The
cattle wade in the creeks and streams and consequently
leave their "cow pattys". I've never seen anyone with a
big 'ol pooper scooper cleaning up the droppings!! Maybe
you and Ms. Post should go in together and buy a condo in
downtown Buckhead!!!!
