The company that has run Winder’s water and wastewater operations for a dozen years is taking the city to court over the new administration’s attempt to cut back on some of the contracted services. In a petition for declaratory judgment filed March 5, H.S. Feldman Inc. states that none of Winder's contracts and amendments since 2000 allow city officials to unilaterally terminate any services.
The document, which the Barrow Journal obtained from the office of the Clerk of Barrow County Superior Court, says that a 2009 amendment added environmental services and extended Feldman’s contract until Dec. 31, 2024.
In exchange for the extension, the company reduced its monthly billings for 12 months at a savings to the city of $290,004, states the document.
But last August the company learned that the city no longer wanted it to perform the environmental services regarding storm water, watershed protection and fats, oils and grease.
