A suspect in a road rage incident apparently punched another driver in the face during a confrontation on Ga. Hwy. 53, according to an incident report from the Jackson County Sheriff’s Office.

A 50-year-old man said he was driving from Braselton to Winder along the state highway when he passed a slow-moving Chevy Tahoe that was traveling about 45 to 50 m.p.h. The driver of the Tahoe then followed the Winder man until he pulled over at John’s BBQ, located near the Jackson-Barrow county line on Ga. Hwy. 53.

The driver of the Tahoe then approached the Winder man, where he asked the driver of the Tahoe, “What his problem was,” according to an incident report.

The driver of the Tahoe punched the Winder man in the face at least two times before the Winder man said he sped out of the parking lot. The Winder man then pulled back into the parking lot and the Tahoe driver pulled back on to Ga. Hwy. 53 and drove into Barrow County.

The Winder man followed the Tahoe to Forest Hill Road in Barrow County, where the driver turned off of the roadway. The Winder man called 911 and Barrow County deputies escorted him back to the barbecue business in Jackson County, where a deputy met him.

A Jackson County deputy said the Winder man had a large black eye with an open cut under the right eye. His shirt was also covered in blood. An ambulance was called to the scene, but he refused to be taken to a hospital.

The Winder man also pointed to a dent on his vehicle’s driver’s side door, which he said was caused by the Tahoe driver.

The Winder man said the Tahoe driver was a white male in his 30s, about 5’ 09” and weighed about 180 pounds, according to an incident report.

thats why i pack heat. had the tahoe driver approched me in said fashion he would have been left a in a pool of his own blood. if there proved to be no weapon on his lifeless body , well thats what a throw down piece is for.

The place for someone like that is anger management, not a coffin. Everyone has bad days. Some have really bad days.

That guy could have a family. Do you really want to be the guy to ruin the lives of people who had nothing to do with the fight?

Being made, flipping someone off, acting like a jerk is one thing, if your anger management problem means you attempt to assalt me, my family or others

I got a anger management solution if you (or he) can't seek help BEFORE Assalting other people, and his family Will suffer for his bad choice, HIS anger problem.

If you are DEFENDING yourself, So what if you shot him, you dont need a throw down piece, you "were in fear for you safety and life" by an aggressive attacking person.

If you Pass me, I dont care, that just means I am not holding you up anymore, why did this idiot even care that you passed him?

If you go slower, you get passed, So what. Go faster or let people pass, pick one.

I agree, he would have rushed me and been stareing down a barrel when made it to me.

I am thinking the VICTIM here may have been the Road rager and it went awry! first he was involved in incident that didnt involve hitting cars or near accident, then he puls over in BBQ place probably empty then he rolls down his window this story seems little fishy. thinking he was the Road Rager and when he confronted other driver the driver showed him who the person needed to show respect! move on police this story stinks!

You are just guessing that the "victim" caused the the incident, because in your (small)mind "may have been..." So you just invent your own facts?

Fact: It doesn't matter that these two did or didn't road rage at each other. One decided to take it beyond "road rage" and now should face charges, Period.

One guy didn't cuss another out or gesture or honk his horn, he assaulted someone.

You seem to side with his behavior so I would assume you would assault someone you were mad at in traffic? -Or would you want someone in your family assualted?

I just want to say that i'm a firm beleiver in your right to carry a firearm. Thats cool and i have a few of my own. But with that being said, people commenting and saying they would have shot the guy sound pretty pathetic.

Road Rage has happened to every single person who has ever driven any significant amount. Whether it was your fault or not. But to think that someone deserves to die for confronting you on an issue is insane.

The funny thing is most people with the whole "im too old to fight. I'll just shoot them" mentality really arent too old to fight. They're too out of shape and fat to back up their big mouths.

Story sounds fishy. Not enough detail to speculate. Dude was probably riding the tahoes butt b/c the tahoe guy was taking his sweet time and got all worked up and flew by him honking etc. I'd even bet he flipped the guy the finger. Either way the problem was solved and no one died as a result. Just some poor guys pride got hurt.

heres the problem with your summation. guy is driving behind me in a crazy fashion, obviously "loosing his cool", we get to a redlight or I pull over to let him go around, some such scenario could happen where a nut job gets out of his vehicle looking for a physical confrontation.happens all the time, you can read about it in the papers.Im in my car, i dont know if he's armed or not, but I know I am.if I can leave I would , butif he is armed whats tostop him from shooting me in the back and then driving off. I say if Im in that situation I will shoot first and ask questions later quite frankly this nut bag is not worthy of my consideration if he has gone this far in seeking a confrontation. I guess the moral of the story is that if you are a road rage nutbag like the guy in the tahoe in this story you better be careful and change your ways because more and more people are carrying and not one of them owes you a damn thing.

Not quite, "Einstein". Learn your laws. The use of deadly force is completely legal and justifiable to prevent any forcible felony or misdemeanor against person or property. The situation in question is clearly a forcible crime. Had he exited his vehicle and approached me in a threatening mannor as I'm sure he did the victim, he wouldn't be able to ever do it to anyone else again I promise you. I dont care if said person has a family either. I have one as well, and if someone tries to harm any of my family, I will defend them by whatever means needed. Just as the man with a knife discovered when he attempts to stab and rob me a few years back. And yes, I'm proud of it. I'm still here on this earth to tell the story and remain with family.

OCGA 16-3-21- USE OF FORCE "A person is justified in threatening or using force against another when and to the extent that he or she reasonably believes that such threat or force is necessary to defend himself or herself or a third person against such other´s imminent use of unlawful force; however, except as provided in Code Section 16-3-23, a person is justified in using force which is intended or likely to cause death or great bodily harm only if he or she reasonably believes that such force is necessary to prevent death or great bodily injury to himself or herself or a third person or to prevent the commission of a forcible felony"

(3) The person using such force reasonably believes that the entry is made or attempted for the purpose of committing a felony therein and that such force is necessary to prevent the commission of the felony"
Forcable Felony...Yes....Misdemeanor against person or propery...NO. I would love to see you shoot someone who hits yous mailbox with a baseball bat. See how that turns out for you in court. Can see it now "UMM ladies and gentlemen of the jury, what we have hear today is someone who REALLY LIKED HIS MAIL, so much that he shot and killed the kid who hit his mailbox"

Then again if you got the same jury in the Casey Anthony case, you would be justified.

B.L.B, You may want to "learn YOUR laws" EINSTEIN. As stated in Umm..check your facts post, you are NEVER justified in using deadly force against a subject commiting a Misdemeanor. Unless one is in eminent deadly danger you should think first what it means to take another life, its forever. Its not a pretty life long thought picture to remember a blown away face and hear the last breath of a dying person. Ask some of of combat friends. But if it is absolutely necessary and no other way out, do it quick. Try to get away first.

not to be stupid, do not put yourself in postion of having to make statements and claims that only two people are party to, also worse place to be is in your car trying to get out when person you are in conflict with has leverage and advantage when you make choice to engage that person, only smart idea is to put car in gear and leave, not roll down window and engage, you dont have attack ability of any deal, you will lose, cannot exit your car without risk of geetting body trapped by car door meaning many damaged parts of your body, the only smart thing is not to engage, not be wiseacker and try to think when your both elavated in emotions that you will come out ahead in any way.

Duty-

I could not agree with you more. I have a concealed carry permit and am a firearms enthusiast and I think the best thing is to avoid confrontation using any method available to you. Whenever you shoot someone you are going to be investigated by a grand jury and possibly indicted. You'll probably escape indictment for using deadly force to defend yourself in Barrow County, but would you really want to take your chances in front of a grand jury in Fulton or Dekalb counties? Not me!

What is with gun nuts? The man in charge of the country said certain people who feel threatened retreat to religion and gun during those times. When Obama is re-elected -- and, face it, he doesn't have much opposition -- and gets to appoint ONE justice to the Supreme Court, you can kiss those two favorable decisions regarding the 2nd Amendment [applying to an individual right to bear arms] goodbye.

I'm just glad that neither of these guys pulled a gun on the other. One fellow ended up with a black eye and the other should be prosecuted for assault, but no one ended up dead.
