James Morris "Jim" Lynn pleaded "not guilty" Monday at an arraignment in front of a Barrow County Superior Court judge. Lynn faces charges for the murder of his 38-year-old Winder wife Tonya Faye Royster Lynn.

"if convicted, life without parole" Brad Smith. Why did he enter not guilty when he already admitted it and why is Smith not seeking the Death Penalty ?

More than likely, Lynn was at an arraignment, which is nothing more than a formal reading of the indictment and a formal "not guilty" was entered. If a DA is going to pursue the death penalty, the State has to show where the crime had aggravating circumstances, i.e. it was a particularly gruesome or cruel crime, involved other felonies like rape or armed robbery, or if they killed a government officer (police, federal officer, etc.) in the line of duty.

Unfortunately, I don't think this is a matter of Brad Smith not doing his job, it's a matter of proving the elements for a death penalty case, even though this James Lynn jerk probably deserves it.

I agree with Angel. And besides, his attorneys, who are no doubt court appointed, are going to make sure they suck on the public teat for a while before they let this one go.

I understand that part, but the fact the he did committed murder with malice intent should be enough. He went to her, got her alone, bashed her in the face and back of the head, drug her to the well ( I think it was on family property) and then had his girlfriend pick him up in front of the library. All that should be enough to show he planned on killing her, not to mention his first wife "committed suicide", he beat Tonya throughout their marriage and even took a bat to her boyfriends car, the guy needs to be put down for the sake of society and no reason for us to feed and house him

I have asked you several times to please stop posting all your "details" online!!!! If you are going to write comments on here make sure you know the facts!! The details in which he killed her have not been made public. Yes it has been told that he used a bat but not that he beat her face with a bat!!! You are continuing to cause more pain to her family and children with your incorrect facts!!! If you knew her and her story or her beautiful babies you would leave it alone!!! Her children dont deserve to read these comments!!! If you have nothing better to do than spread your incorrect information on the Barrow Journal GET A LIFE!!! Go volunteer at a battered womans shelter!!!

Since Brad Smith dropped the death penalty for that mass murderer in Jackson County who killed four people, including burning his two kids up in the house, he isn't going to go after execution for anyone. That guy was the worst of the worst and Brad Smith dropped the death penalty for him.
