hhmmmm maybe its the whole arresting too many people causing new crime wave!!!!
some counties already charge 50 plus a day for the privelige of not posting bail to NON convicted inmates!!!!
•Misty Dawn Milligan, 24, of 177 Ernie Way, Statham; felony probation violation, seven counts felony theft by taking, two counts false imprisonment, possession of firearm or knife during commission of a crime, conspiracy to commit a felony, two counts aggravated assault, two counts armed robbery
this deputy is out of control, http://www.youtube.com/watch?v=5udvoobYoqI
many have been defending this Sheriff and his deputies saying they dont mind being video taped, luckily local city cops showed up and this didnt escalate to an arrest.
a private citizen on his property first at start of tape Deputy becomes the one starting the escalation by raisng his voice as if he had already asked for license, then threatening to have this guy arrested for obstruction, how can he be obstructing when there is no crime?
also threat to have the car impounded.
How about rather then this officer becoming threatening and attempting to arrest someone for "obstruction" which by the way since there is no CRIME there is no obstruction. he treated the person as a person not as inmate in the county jail.if he hadnt been rolling his tape he would have been arrested and the police report would have pointed out how good a job this deputy did and car impounded and so on.
but since he did have tape rolling the deputy didnt arrest him on the bull crap charges he threatened to.
Also, please spell check your post, it's hard to understand.
and if people called him billy then it is not false information as held by the United States Supreme Court.
also saying nothing would meet the requirement not responding at all to officer. would meet the requirement by law not by what Police wish the law is, so they can threaten and bully people under Color of Authority
interesting Officer from Cobb once came up demanded to know who I was what I was doing, I told him I am doing my business good Day.
he called for back up I gave my lawyers card and told those officers if they choose to arrest me then here is my lawyers name and number.
they went on about trying to do whatever they where doing and left me alone.
one cant obstruct if there is no crime.
just a nosey police officer not getting answers he likes is not obstruction.
Boo Whoo poor Deputy
16-10-24. Obstructing or hindering law enforcement officers
(a) Except as otherwise provided in subsection (b) of this Code section, a person who knowingly and willfully obstructs or hinders any law enforcement officer in the lawful discharge of his official duties is guilty of a misdemeanor.
Definition of HINDER
transitive verb
to keep back; restrain; get in the way of; prevent; stop
to make difficult for; thwart; impede; frustrate
Origin: ME hindren < OE hindrian, lit., to keep or hold back (akin to Ger hindern) < base of hinder.to delay action; be a hindrance
adjective
So by him not giving identification he "made it difficult" and "prevented" the deputy from doing his job and investigating a suspicious vehicle parked in an empty business, while closed late at night. All this citizen had to do is give ID, answer a few questions and be on his way. Instead he wanted to be a jack$& and make an ordeal out of it. I bet if his business was broken into he would be the first to complain about it and bash the cops for not doing the job.
'The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.'

Was your UGA diploma printed in crayon on construction paper?
Name calling, spiffing off is all that ever comes out with law enforcement. He thinks we don't need them because I am sure he has never ever broken even a tiny law.
other then exercising the right to the 5th amendment just because you wear a badge doesnt mean people have to listen to you when you are not legally doing your job.
some may risk being put in jail by an officer when this happens but by standing up when officers over step the authority limited by the constituition then they also may face a stay in the Greybar Motel.
See the law does not require Govt Id only that the person identify himself. also states he may at trial do so, he is not required under Georgia law to present Identification and be violating the law.
had the officer arrested him at trial he found not guilty then we would have seen a lawsut most likely for violating this citizens rights.
no where is the requirement for D.O.B. he gave his name stated he was the person whose property the deputy was on,
what obstruction is there none, like I said thank goodness he had his cell phone taping
the guy gave his name but refused to give his date of birth Deputy threatened to arrest him for obstruction, and impound the guys car.
luckily the guy had his camera rolling and Statham local cops showed up for backup.
instead of other county police.
the deputy started acting like he asked for drivers license more then once was loud about it.
the guy wasnt driving just by his car so he didnt need any id.
once he told the deputy it was his business and the deputy wanted to know why he was at his business they guy said I dont have to share with you why i am anywhere, which is true, it is none of the Police business where one is going or coming from, as long as they arent commiting a crime.
unless you have a awarrant or are wanted and Police ask you who you are you can just ignore the question, now unless you have tape rolling this will probably get you arrested but that doesnt mean you commited any crime.
