Winder City Councilman Charlie F. Eberhart on Tuesday night secured his right to vote in Winder and Barrow County, which means he will remain on the Nov. 8 ballot in the city’s Ward 2 contest.

Following an hour-long hearing at the county government’s headquarters building, the Barrow County Board of Elections & Registration voted 3-0 to affirm 131 King St. as Eberhart’s official residency. That is the address of Eberhart & Son Mortuary, where he says he resides.

Voting in Eberhart’s favor were vice-chairperson Kathy Garrett and John Reavis, who are the board’s two Republican Party appointees, and Beth Smith, one of the two Democratic Party appointees.

Of course he was declared a Winder resident. You didn't seriously think that they would suddenly admit to being wrong about his residence all this time, did you?

I’ll say it because it needs to be said. This entitlement sh… has gone too far. Charlie Eberhart lives in a funeral home in Winder like I live in the White House in DC. Barrow County Board of Elections get your head out of the sand. You look like fools and you don’t deserve your jobs. I hope Mr. Cooley appeals this thing and gets a lawyer involved, that’s the only way the Board will listen. I would also recommend contacting the State Attorney General’s Office to look at Mr. Eberhart making false statements and writings regarding his council position application.
Board of Elections be careful not to trip on all that crap you have swept under the rug. People of Winder and Barrow county you are being cheated by this joke of a Board.

I'm sorry but you must be new here, This is Barrow County were the elected rule because they said so not because the law said so... Rule of law means nothing when you can use the city / county legal resources to fight and run off anyone who says different no matter how much it cost.

Do you live in Winder? If so, then you know Charlie does not live in that funeral home. You simply cannot say otherwise. We all know it, that's what makes that Board such a joke.

Talk about that, not the messenger. I don't know Mr. Cooley but I do know his concerns are valid. And for the Board to just let it go and make a joke about how couples live is a disgrace. The Board is fooling no one and their actions pollute their credibility. They have removed all authority entitled to them by treating this in the manner they have. The State of Georgia needs to look at this and the Board.

like it or not defines and burden to prove one doesnt reside where they claim is like disproving God.
secondly it is no ones business where one sleeps maybe he does as lot of funeral directors do sleep in the funeral home
The man who founded Marshall Fields used to sleep in his stores to save money,
My Baker used to sleep in his bakery till he saved enough money to pay cash for a home.
sleeping where one works saves on any things like fuel, heting two places having to open the door to go out to eat. etc
I applaude him for being so conservative with his personal life.

Oh come on people. We all know Charlie lives in Athens and has for years. He gets by for one reason and one reason only. He is a black man and most of the people in his district are black. The city is just to chicken to do anything about it for fear of getting the NAACP involved. They don't want Jesse coming to town. Name one. Just one other city councilmen that could pull this off and not live within the city limits.

What does him being black and having black supporters have to do with the board decision? Was any of them black that made the decision? After all they were the one that made the decision, not his BLACK supporters. So, why are you trying to throw race into this? And based on Cooley's sarcastic responses in the comment sections on these articles-not just this one-I wouldn't vote for him anyway.

Jim Cooley would have been a disaster as a councilman! Seriously. Just look at him or listen to him. Charlie Eberhart has served the city and its citizens well for a long time, both as a funeral director and a councilman. Since he's on call 24-7 at his funeral home and probably spends the lion's share of his time there, I have no problem with him spending a little time with his wife - even sleeping with her - in Athens sometimes. Come on folks. Let's not get crazy here!

What exactly is the zoning for the funeral home? residential or business? Can one "reside" in an area zoned for business?

it is zoned C-3 Commercial, no...one can't reside in a commercial property for voting rights, if there was a separate apartment...like in downtown winder, where there are apartments above businesses...then that would be legal.

Keep in mind that, according to state law, it was up to Mr. Cooley to prove that Mr. Eberhart doesn't reside in Winder. The fact that "everybody" "knows" that he doesn't does not prove anything. Mr. Cooley had NO evidence to support his position, and the board, as a result, didn't have much of a choice. The only real evidence that he provided was information that Eberhart's wife lives in Athens, and claims her home as a homestead - a home she owned before she and Charlie were married.

What is really "obvious" is that Cooley is a bit weird. It isn't normal for one man to follow another around. Cooley is not a lawyer, cop or private investigator. A hot-headed bully lacks the temperament for public office. Perhaps he and bloviating "Jack Legg" should form a presidential GOP ticket.

Mr. Cooley - I have NEVER refused to talk to you. You dropped by my house, unannounced, and I wasn't home. (I was doing volunteer work at our local library, if you want to check it out - I'm there most Wednesday and Thursday mornings.) You told my wife that you wanted to talk to me, but didn't leave a number. Now,I guess I could have looked you up, but I didn't feel like making the effort. If you want to talk to me, make an appointment. I'm in the book. BTW, I have a Charlie Eberhart sign in my front yard now. Picked that up on the way home from the library on Wednesday.

I realize, Mr. Cootie, that every time I respond to you, I lengthen your 15 minutes of fame. So, this will be my last comment until the voters have spoken. Jim, what kind of person do you think you are? Why would you think the citizens of Winder would even want you on the council? You get on here and blog like a mad man - have some dignity about yourself and the city and keep your mouth shut. If this is any kind of indication as to what kind of person you are, then I surely don't want you on the city council. Jim, look around you and learn a few things then maybe you can run again next election - you don't have a change with the attitude you have. Get some self-respect...

Not that I would vote for Cooley, I think he is a complete nutcase, BUT isn't there an ordinance against using a business (commercial) building as your residence?

If not, then I think I will lease a building in downtown Winder, pop a bed in the back room -- call it home; Thereby changing the county commissioner district I'm in. WOW I could run for BOC ever four years by simply hopping between my "real" home and my "fake" building/business home.
