I have seen Police decide is it going to hurt or help someone to put them in jail, is it going to cause them to lose job, family health. (not in Barrow county) but the other officers I have seen help people they dont know and dont expect to ever see again not just arrest and fill the jails.

well herein lies the problem first off in the u.S. supreme court ruling the prima facia basis for loitering to be valid would be the requirement for Law officer to order person to leave. the Ga code first off lacks that in its statue.
second the person was arrested one charge dealing with bond being removed, so it would seem if linked he wasnt loitering. I am just guessing but this probably happened in regards to the bondmans office. just an idea though.
and thus if it is then you can see the loitering thing is just load of crap. one more charge that is full of many problems.

Second, We HAVE to enforce all of the laws whether we like them or not. What is immoral to you may not be to others. But give me an example for one of these laws. We are sworn to uphold both. We cant pick and choose which ones we want too. Now i will say that on some things we do have officer descretion, not many, but some. And yes, there are those officers that take enforcement to extreme, the ones who would give their own mother a ticket. I choose to be an officer that uses reasonable enforcement, when I can. Like I said, there are some laws that we MUST enforce, without question, or be writen up, suspended or even fired. I need my job.

Second no enforcement agency can force a officer to make arrest or even write tickets, I know one officer who made many arrests and I know one officer who always got jeered cause he didnt make many.
I know one officer on Traffic he wrote his tickets, he showed up to court but he told the people plead not guilty.
The judge had no problem kicking on one day he had 17 cases 16 dismissals one guy plead guilty.
also Judge Booth runs good Court, he has kicked cases that even though drugs were found or people on probation lacked the merit due to no cause.
I am saying it isnt easy job but it isnt hard as the guy who comes does my landscaping either.
even if search is conducted without asking for consent there is other then invasion of privacy issue little a court would do or few lawyers that would take that case.
and yes sometimes officers just start opening compartments and searching without asking. not in Barrow county but in county close to Barrow, minor delay in my day but since I dont have illegal items in my car or on my person found it disturbing and an annoyance.
had I had something I probably would have been arrest car impounded had to post bond and in the end the charges dismissed.
I dont think the FISHING stop and search plan is good and it is not constitutional for sure but lacking willing to spend 10 K for lawsuit there is little we can do other then elect Sheriffs and politicians that keep citizens right first and foremost.
