The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below.
Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements on June 30, 2011, with Superior Court Judge Currie Mingledorff presiding:
• Luciano Juarez, battery, simple battery family violence, criminal trespass, simple assault family violence: 24 months probation, no violent contact with victim(s), psycho-sexual evaluation, completion/attendance of evaluation/treatment for family violence intervention and a $1,000 fine.
The following sentences were issued as part of negotiated plea agreements on June 30, 2011, with Superior Court Judge Penn McWhorter presiding:
• Kelley Wylean Carder, DUI-drugs, reckless driving, failure to maintain lane: 12 months probation, abstain from use of alcohol and narcotics and submit to random alcohol/drug screening, 100 hours community service, completion/attendance of evaluation/treatment for alcohol/drugs, completion/attendance of evaluation/treatment for risk reduction, abide by any curfew and a $1,500 fine.
• Robert Headrick, driving under the influence (DUI)-less safe, no insurance, failure to maintain lane, too fast for conditions, tire requirements: 48 months probation, completion/attendance of evaluation/treatment for alcohol/drugs, abide by any curfew and a $500 fine.
• Michael Lee Richards, DUI-less safe, failure to maintain lane, theft by receiving stolen property, obstruction of officers: five days confinement, 12 months probation, 50 hours community service, completion/attendance of evaluation/treatment for alcohol/drugs, completion/attendance of evaluation/treatment for risk reduction, abide by any curfew and a $1,400 fine.
• Randy Fancisco Medex-Chavez, driving while unlicensed: $500 fine.
• Karen Hudson, battery family violence: 12 months probation, no violent contact with victim(s), abide by any curfew and a $500 fine.
• Matthew Shipman Jr., theft by taking: 12 months probation, abstain from use of alcohol and narcotics and submit to random alcohol/drug screening and a $300 fine.
• Mindy Dawn Milligan, simple battery family violence: 12 months probation, completion/attendance of evaluation/treatment for family violence intervention, no violent contact with victim(s), abide by any curfew and a $300 fine.
• Lamadre Marquis Tanner, two counts simple battery family violence, disorderly conduct: 12 months probation, abstain from use of alcohol and narcotics and submit to random alcohol/drug screening, completion/attendance of evaluation/treatment for family violence intervention, no violent contact with victim(s) and a $1,000 fine.
• James J. Kennedy, speeding-guilty, speeding, driving while unlicensed: 60 days confinement.
• Corey Simmons, driving while license suspended-felony: three years probation, abstain from use of alcohol and narcotics and submit to random alcohol/drug screening, abide by any curfew, and a $1,000 fine.
• Kristy Lynne West, battery family violence, disorderly conduct: 12 months probation, completion/attendance of evaluation/treatment anger management at defendant’s own expense, abide by any curfew and a $500 fine.
• Katrina Carlene Green, forgery-1st degree: 10 years probation, serve three years suspended upon successfully completing drug court, abstain from use of alcohol and narcotics and submit to random alcohol/drug screening, $400 restitution to victim(s), complete MRT classes and a $1,000 fine.
• Katrina Carlene Green, giving false information to a law enforcement officer: 12 months probation, abstain from use of alcohol and narcotics and submit to random alcohol/drug screening, abide by any curfew and a $500 fine.
