Officers from the Winder Police Department were at a gas station on East May Street New Year’s Day when a Dodge Caliber pulled into the parking lot and parked extremely close to the officers marked patrol vehicle.
The driver, Zachary Lord, exited the vehicle carefully as to not hit the patrol car and went into the store where he began arguing and cursing at other customers.
After Lord exited the store he got back into his vehicle and was approached by WPD officers.
While speaking with Lord, officers noticed a strong presence of alcohol on his breath and when asked if he had any alcohol that evening he said he only had two beers.
Officers asked Lord if he would submit to a field sobriety test to which he agreed.
During the horizontal eye test officers noticed a severe lack of smooth pursuit and that Lord was swaying back and forth during the test.
Lord then failed the “walk and turn” test, losing balance several times in the process.
After failing another test Lord was placed in handcuffs and arrested for driving under the influence and disorderly conduct.
Lord refused the breathalyzer test and again stated that he was not drunk.
Lord cried, screamed and yelled all the way to the Barrow County Detention Center where he blew a .280 on the Intoxilyzer.

Does anyone know what his second breath registered? Cause under Georgia law it states that if the second breath is preceeded or exceed by the amount of 0.02%, the results are inaccurate.
