Sentences issued in Superior Court Sept. 23-24
The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements on Sept. 23, 2010 with Superior Court Judge T. Penn McWhorter presiding:
•Cornelius Butler, giving false name to a law enforcement officer: 45 days confinement and drug rehabilitation.
•Kimberly Nicole Elliot, obstruction: 12 months probation, 40 hours of community service and a $500 fine.
•Matthew Dewayne Land, giving false name to a law enforcement officer and driving while license suspended: 12 months probation and a $1,250 fine. Seatbelt violation: nolle prosequi. •Jawanza Smith, simple assault: 12 months probation, no violent contact with victim, complete family counseling and pay a $500 fine. Family violence simple battery: nolle prosequi.
•Kevin Edward Mosley, family violence simple battery: 12 months probation, no violent contact with victim and a $500 fine. Criminal trespass: nolle prosequi.
•Krista Kay Teeter, family violence battery and disorderly conduct: 12 months probation and a $1,000 fine. Family violence simple battery: nolle prosequi.
•Tammy Michelle Hawkins, family violence battery: 12 months probation, no violent contact with victim and a $400 fine. Disorderly conduct: nolle prosequi.
•John Anthony Hartman, simple battery: 12 months probation, no violent contact with victim and a $400 fine.
•Robert Stephen McCain, obstruction: 12 months probation and a $500 fine.
•Betty Lynn Phillips, DUI: 12 months probation less 24 hours confinement, 40 hours of community service, parenting classes and a $1,000 fine. Child endangerment, seatbelt violation and failure to carry license: nolle prosequi.
•Sabrina Lue Wilson, interference with custody and contributing to the delinquency of a minor: two years probation, no unsupervised contact with children under 18 who are not the defendant’s children and a $1,000 fine. Additional two counts of contributing to the delinquency of a minor: two years probation, parenting classes and a $1,000 fine.
•Jason Matthew Timms, disorderly conduct: 12 months probation and a $500 fine. Obstruction: 12 months probation and a $500 fine.
•Emilia Perez Duran, criminal trespass: 12 months probation less six days confinement and a $1,000 fine.
•John Scott McLean, family violence battery: 12 months probation, no violent contact with victim and a $500 fine.
•Jamarcus Lee Mayweather, DUI: 12 months probation less 24 hours confinement, 40 hours of community service and a $750 fine. Failure to maintain lane: nolle prosequi.
•Gabriel Joshua Henry, family violence battery pled to lesser included offense of battery and interference with a 911 call: 30 days in jail, one year and 11 months probation, take medications as prescribed and pay a $500 fine.
•Diana Esther Garcia, reckless driving and failure to maintain lane: 12 months probation, 20 hours of community service and a $1,050 fine.
•Kevin Brent Edwards, DUI and failure to maintain lane: 12 months probation less 24 hours confinement, 40 hours of community service and a $750 fine.
•Johnny Ferguson, terroristic threats pled to lesser included offense of simple assault: 12 months probation and a $500 fine. Terroristic threats and two counts of simple assault: nolle prosequi.
•Zachary Allen Warziniack, family violence battery pled to lesser included offense of battery and family violence simple assault pled to lesser included offense of simple assault: 12 months probation, 40 hours of community service and a $1,000 fine. Two counts of third degree cruelty to children: nolle prosequi.
•Miranda Marie Burgess, use of fighting words and obstruction: two years probation, attend narcotic anonymous, no violent contact with victims and a $1,000 fine.
•Robert Shawn Williamson, family violence simple battery and criminal trespass: two years probation and a $1,000 fine.
•Steven Andrew McClain, criminal trespass: 12 months probation, restitution and a $500 fine.
•William Gerard Mooney, disorderly conduct: 30 days in jail, 11 months probation, take all medications as prescribed, undergo mental health evaluation and pay a $500 fine.
•Martin Sandoval, simple battery and criminal trespass: 12 months probation less 29 days confinement and a $1,000 fine.
•Patrick Carew, two counts simple battery and two counts of battery: four years probation and a $2,000 fine. Aggravated assault: nolle prosequi.
•Barbara Bushey, public intoxication: 12 months probation less 35 days confinement and a $250 fine. Public indecency: nolle prosequi.
The following sentences were issued as part of negotiated plea agreements on Sept. 24, 2010 with Superior Court Judge Joseph Booth presiding:
•Jeremy Lewis Phillips, VGCSA: five years probation and a $1,000 fine. Improperly maintained tail lights: nolle prosequi.
•James Renfroe Jr., possession of alprazolam, possession of diazepam, DUI less safe and seat belt violation: five years probation, 40 hours of community service, DUI/risk reduction and pay a $2,765 fine. DUI per se: nolle prosequi.
•Cornelius Jackson, first degree forgery: two years probation and a $500 fine.
•Roberto Villalobos, three counts VGCSA: ten years probation and a $2,500 fine. Possession of a firearm during the commission of a crime and possession of marijuana with intent to distribute: nolle prosequi.
•Joshua Marcus Smith, entering auto and theft by taking: two years in jail, three years probation, restitution and a $1,000 fine.
•Brandi Skinner a.k.a. Brandi Louise Knight, two counts theft by taking: two years to serve suspended upon the completion of six months of intensive probation, ten years probation, complete Moral Reconation Therapy, pay restitution and a $2,000 fine. Theft by receiving stolen property: nolle prosequi.
•Thomas Chad Brown, family violence battery: 12 months probation less 20 days confinement, no violent contact with victim and a $500 fine. Additional count of family violence battery and one count of family violence simple battery: nolle prosequi.
•Mark Alan Pestel, DUI and failure to maintain lane: two years probation, 40 hours of community service and a $1,500 fine. Three counts VGCSA, two counts of drugs to be kept in original container and possession of drug related objects: nolle prosequi.
•Adam Coursey, theft by taking: 12 months probation, restitution and a $500 fine.
•Eric Shane Waddell, two counts of family violence aggravated assault, false imprisonment and possession of firearms by a convicted felon: three years in jail, 17 years probation and a $3,000 fine. Additional count of aggravated assault, additional count of false imprisonment, discharging a firearm while under the influence, criminal trespass and two counts of family violence battery: nolle prosequi.
