Sentences issued in Superior Court Aug. 23-25
The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements on August 25, 2010 with Superior Court Judge Currie Mingledorff presiding:
•Kenneth Todd Deal, sale of methamphetamine: 15 years probation, three years to serve suspended upon completion of six months intensive probation and a $2,000 fine.
•Charles Phiri, driving without a license: 12 months probation suspended upon payment of $250 fine.
•William Demarcus Howard, sale of cocaine: first offender treatment, ten years probation and a $5,000 fine.
•Kevin Carter Green, conspiracy to obtain a controlled substance by fraud: ten years probation, four years to serve suspended upon successful completion of drug court and a $1,000 fine. Simple battery: 12 months probation. Obtaining a controlled substance by fraud and drugs to be kept in original container: nolle prosequi.
•Roger Bredow, two counts of disorderly conduct merged with one count of simple assault: two years probation and a $2,000 fine.
•Shannon Osborne Swierczek, two counts reckless conduct: two years probation, parenting classes and a $1,000 fine.
•Kenneth James Moore, shoplifting: 12 months probation, restitution and a $750 fine. VGCSA and drugs to be kept in original container: nolle prosequi.
•Jonathan Spratlin, battery: 12 months probation and a $500 fine.
•Quentin Jerome Evans, family violence battery: five years probation, two years to serve suspended upon completion of intensive probation and a $1,000 fine. Affray: 12 months probation and a $500 fine.
The following sentences were issued as part of negotiated plea agreements on August 23, 2010 with Superior Court Judge David Motes presiding:
•Cary Guy Boozer, possession of less than one ounce of marijuana: 12 months probation. Family violence battery, first degree cruelty to children, two counts family violence simple battery and third degree cruelty to children: first offender treatment, five years probation and family violence intervention. Family violence simple assault and criminal trespass: nolle prosequi.
•Bobby Joe Duncan, family violence aggravated assault: ten years probation and a $2,000 fine. Additional count of aggravated assault and third degree cruelty to children: nolle prosequi.
•Christopher Eugene Hammond, family violence aggravated assault pled to lesser included offense of family violence battery: 12 months probation and a $750 fine. Family violence battery: nolle prosequi.
•James Dewey Foots, felony obstruction pled to misdemeanor obstruction, interference with government property pled to criminal trespass and DUI less safe pled to reckless driving: two years probation, restitution and a $1,500 fine. Driving on the wrong side of the roadway: nolle prosequi.
•Steven Benjamin Heard Jr., theft by receiving stolen property, obstruction, driving without a license, no insurance, operating unregistered vehicle, driving on wrong side of roadway and equipment violation: three years probation and a $1,500 fine. Fleeing and attempting to elude: nolle prosequi.
•Amory Jackson Barrett, family violence aggravated assault and family violence battery: 15 years probation, three years to serve suspended upon completion of six months intensive probation, attend narcotics anonymous during probation and pay a $2,000 fine. Terroristic threats and simple battery family violence: nolle prosequi.
•Mohammed Duke Koroma, possession of cocaine and DUI: ten years probation, 40 hours of community service and a $2,250 fine.
•James Randall Day, family violence aggravated assault, terroristic threats, family violence battery and disorderly conduct: first offender treatment, 15 years probation, two years in prison suspended upon completion of six months intensive probation and a $3,000 fine.
•Ronald Robert Head, possession of cocaine and DUI: 15 years probation, 40 hours of community service, three years to serve suspended upon successful completion of residential substance abuse treatment and six months intensive probation and a $2,750 fine. No tag light and failure to maintain lane: nolle prosequi.
•Christina Hammond, VGCSA and use of a communications facility to facilitate VGCSA: ten years probation, serve two suspended upon completion of six months intensive probation and a $2,500 fine.
•Nicholas Allen Fisher, criminal attempt to sell marijuana: first offender treatment, two years suspended upon 120-180 days in detention center, eight years probation and a $2,000 fine. Possession of MDMA: nolle prosequi.
The following sentences were issued as part of negotiated plea agreements on August 26, 2010 with Superior Court Judge T. Penn McWhorter presiding:
•John S. Hardegree III, two counts of public nuisance - vicious animal: restitution and a $110 fine. Two counts of failure to control animal: nolle prosequi.
•Joshua Earl Goins, disorderly conduct: 12 months suspended upon payment of $500 fine.
•Timothy Jones, DUI: 12 months probation, 40 hours of community service and a $750 fine.
•Mark Everett Griffin, affray: 12 months probation and a $500 fine.
•Timothy Lee Mize, affray: 12 months probation and a $500 fine.
•Gregory Leonard Pole, disorderly conduct: 12 months probation and a $500 fine.
•Jeremy Dewayne Stewart, family violence battery and third degree cruelty to children: two years probation and a $1,000 fine.
•Victoria Lynn Stockton, disorderly conduct: 12 months probation and a $500 fine.
•Justin Taylor Elder, obstruction: 12 months probation less 20 days confinement and a $500 fine.
•Shannon Cassie Smith Sweat, fleeing and attempting to elude and obstruction: two years probation less ten days in jail and a $2,000 fine.
•Danny Kinta Brown, disorderly conduct: 12 months probation and a $500 fine.
•William Charon Woody, battery and interference with a 911 call: 12 months probation and a $750 fine. Family violence simple assault and third degree cruelty to children: nolle prosequi.
•Elaine Click, theft by taking: 12 months probation, restitution and a $1,500 fine.
•Jesse Rhome, littering: 12 months probation and a $250 fine.
•Zabed Rahman, simple battery: 12 months probation, anger management classes and a $300 fine.
•Patrick Lee Esco, obstruction: 12 months probation, 20 hours of community service and a $500 fine.
•Cory Nathan Garrett, DUI and possession of less than one ounce of marijuana: 12 months probation and a $1,250 fine. DUI-drugs, DUIprescription medication and failure to carry license on person: nolle prosequi.
•Joshua Gray Gentry, reckless driving, open container and failure to maintain lane: 12 months probation, 40 hours of community service and a $1,050 fine.
•Nicholas Alexander Brown, DUI less safe: 12 months probation, 40 hours of community service and a $750 fine. Failure to maintain lane: nolle prosequi.
•Johnny Fitzgerald Andrews, habitual violator, DUI and driving while license suspended: two years probation less 30 days in jail, 40 hours of community service and a $2,500 fine. Failure to maintain lane and giving false name or date of birth to a law enforcement officer: nolle prosequi.
•Joey Keith Chatham, giving false name to a law enforcement officer: 12 months probation and a $500 fine.
