The Winder Police Department, the City of Winder and Ofc. Chris Stapleton have been named as defendants in a lawsuit filed last week in Barrow County Superior Court.
The lawsuit, filed on behalf of Jackson County resident Ken Parks, stems from an April 2009 vehicle accident in Barrow County.
According to court documents filed Aug. 24, Ofc. Stapleton was southbound on Loganville Highway near Township Road when he made a left hand u-turn in front of Parks’ vehicle which resulted in a collision.
Parks was injured in the accident and, as a result, is facing medical bills, related expenses and “lost wages, past, present and future pain and suffering, mental and emotional anguish and other damages.”
Parks’ attorneys, Perry Ellis and Henry De Give, allege that WPD and Ofc. Stapleton are directly responsible. They accuse Stapleton of being careless in failing to maintain his 2009 Ford Taurus under proper control, failing to maintain his lane of travel and in making an improper u-turn.
“Such negligence was the proximate cause of financial and personal injuries which plaintiff suffered,” the lawsuit claims.
Parks estimates his financial loss at $27,209 which includes medical expenses and 27 weeks of lost wages.
He is seeking damages, court costs and “such other and future relief” as the court deems proper.
Attorneys for Parks have filed requests for production of documents related to the incident and first interrogatories. No court date has been set.
