The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements on August 18, 2010 with Superior Court Judge David Motes presiding:
•Amy Leona Allen, theft by receiving stolen property and interference with government property: five years probation, restitution and a $1,500 fine. Disorderly conduct: nolle prosequi.
•Cody Dillon Shafer, sale of marijuana: first offender treatment, ten years probation, two years to serve suspended upon six months of intensive probation and a $1,000 fine.
•Earl Ray Knight, VGCSA: ten years probation and a $2,000 fine.
•Horace Henry Hutchins, possession of methamphetamine, disorderly house, five counts of furnishing alcohol to an underage person, three counts of contributing to the delinquency of a minor and two counts of tattooing a person under the age of 18: ten years probation, 200 hours of community service, 90 days house arrest, no contact with children under 17 unless family members or at a public gathering and a $7,000 fine.
•James Bishop, burglary: three years in jail, seven years probation and a $3,000 fine. Theft by taking and criminal trespass: nolle prosequi.
•James Bradford, obstruction: nolle prosequi.
•Jessica Nykole Bryant, shoplifting: first offender treatment, eight days to serve, 11 months and 22 days probation and a $1,000 fine.
•Jesus Garcia Delgado, two counts aggravate assault, three counts fleeing and attempting to elude, DUI, DUI less safe, reckless driving, failure to maintain lane, failure to stop at a stop sign and driving while unlicensed: four years in jail, 16 years probation, 240 hours of community service, restitution and a $4,000 fine.
•Joshua Aaron Barnes, sale of marijuana pled to lesser included offense of possession with intent to distribute: first offender treatment, five years probation and a $1,500 fine.
•Laquivas Hunter, family violence simple battery: 12 months confinement.
•Lea Nicole Hall, theft by taking: first offender treatment, five years probation and a $1,500 fine. Theft by receiving: nolle prosequi.
•Lloyd Damien Hudson, possession of less than one ounce of marijuana: 12 months probation and a $750 fine.
•Major Caslin Simmons, possession of hydrocodone: four years probation and a $1,000 fine.
•Ricky Trayton Davis, financial transaction card theft and two counts of theft by receiving: two years probation, restitution and a $2,000 fine. Five counts of aggravated assault, possession of a firearm during the commission of a crime, giving false name and date of birth to a law enforcement officer: four years to serve, 16 years probation and a $5,000 fine. Terroristic threats and four counts of possession of a firearm during the commission of a crime: nolle prosequi.
•Serena D. Parson, two counts of VGCSA: ten years probation and a $2,000 fine. Possession or clorizapem: nolle prosequi.
•Spencer Smith, burglary: three years to serve, 12 years probation and a $2,500 fine.
•Taylor Douglas Vanderford, three counts VGCSA: first offender treatment, ten years probation and a $5,000 fine. Possession of diazepam and possession of a drug related object: nolle prosequi.
•Wesley Allen Bagwell, VGCSA: first offender treatment, eight years probation, three years to serve suspended upon completion of intensive probation and a $2,000 fine.
