Sentences issued in Superior Court August 4 – 5
The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements on August 5, 2010 with Superior Court Judge T. Penn McWhorter presiding:
•Amanda Fay Shepherd, second degree homicide by vehicle and stop sign violation: two years probation, 240 hours of community service, write a letter of apology to the victim’s family, pay restitution in the amount of $6,000 and pay a $1,000 fine.
•Ronald Joe Mathis, two counts of family violence simple battery: two years probation and a $1,000 fine.
•Bobby D. Martin Jr., criminal trespass: 12 months probation, 40 hours of community service, restitution and a $300 fine.
•Douglas Young, stalking and harassing phone calls: two years probation and a $1,000 fine.
•Donald Creightney, obstruction: 12 months probation and a $500 fine. Disorderly conduct and a second count of obstruction: nolle prosequi.
•Mark William Best, DUI less safe: 12 months probation, 40 hours of community service and an $850 fine. DUI per se and improper tires: nolle prosequi.
•Kyle William Adams, DUI less safe: 12 months probation, 40 hours of community service and a $1,000 fine. DUI per se and weaving over roadway: nolle prosequi.
•Arnold Hutchins, DUI drugs: 12 months probation, 40 hours of community service and a $750 fine. VGCSA and failure to maintain lane: nolle prosequi.
•Diana Sue Ballew, obstruction: 12 months probation and a $500 fine.
•Kathleen Bradford, DUI less safe: 12 months probation, 40 hours of community service and a $750 fine. DUI per se and failure to use headlights: nolle prosequi.
•Jeff Mills, possession of less than one ounce of marijuana: 12 months probation and a $750 fine. Disorderly house: nolle prosequi.
•Paul Monroe Statham, family violence battery pled to lesser included offense of disorderly conduct: 12 months probation and a $500 fine. Additional count of family violence battery: nolle prosequi.
•Kimberly Carol Smith, DUI less safe: 12 months probation, 40 hours of community service and a $1,000 fine. Failure to maintain lane and additional counts of DUI: nolle prosequi.
•Jeffrey Wade Mondan, DUI pled to lesser included offense of reckless driving: 12 months probation and a $1,000 fine.
•Linda Dolores Mitchell-Lamison, impeding the flow of traffic, failure to maintain lane and failure to dim headlights: 12 months probation and a $1,300 fine.
•Heidi Ann Freed, DUI: 12 months probation less 72 hours confinement, 240 hours of community service and a $1,000 fine. Speeding: nolle prosequi.
•William Lee Shiplett, DUI less safe and weaving over roadway pled guilty to lesser included charge of reckless driving: 12 months probation, 40 hours of community service and an $800 fine. DUI: nolle prosequi.
•Jennifer Brooks, two counts of family violence battery pled guilty to lesser included offense of battery and disorderly conduct: 12 months probation and a $750 fine. Three counts of third degree cruelty to children: nolle prosequi.
•Kenneth Gordon Wells, driving while license suspended: 12 months probation and a $750 fine. DUI per se, DUI less safe, following too closely and weaving over roadway: nolle prosequi.
•Sentilla Marie Treadwell, two counts theft by shoplifting: 12 months probation and a $1,000 fine. Simple battery, giving false name to a law enforcement officer and public intoxication: nolle prosequi.
•Emily Jackson, giving false name to a law enforcement officer and no insurance: 12 months probation and a $1,000 fine. Suspended registration and tail light required: nolle prosequi.
•David John Hackett, DUI per se: 12 months probation less 24 hours confinement, 60 hours of community service and a $1,000 fine. Driving while license suspended: nolle prosequi.
•Raymond Reavely, possession of less than one ounce of marijuana: 12 months probation, 40 hours of community service and a $750 fine. Family violence battery and criminal trespass: nolle prosequi.
•Charles Ross Burkhalter, child abandonment: 12 months probation and stay current with child support payments.
•Marty Allen Seawright, disorderly conduct: 12 months probation and a $500 fine. Family violence simple assult: nolle prosequi.
•Jonathan Charles Snow, family violence battery pled to lesser included offense of disorderly conduct: 12 months probation and a $500 fine. Family violence simple battery, cruelty to children: nolle prosequi.
•Mark F. Bryant, family violence simple battery and interference with a person making a 911 call pled guilty to lesser included offenses of disorderly conduct and reckless conduct: 12 months probation and a $1,000 fine. Family violence battery and two counts of third degree cruelty to children: nolle prosequi.
•Herman Wayne Johnson, DUI: 12 months probation, 40 hours of community service and an $800 fine.
•Joseph Tyrone Stafford, theft by shoplifting and simple battery: 12 months probation and a $1,000 fine.
•Thomas Lamar Long, DUI: 12 months probation, 40 hours of community service and a $750 fine. DUI less safe, failure to maintain lane and too fast for conditions: nolle prosequi.
•Clifford Daron Davis, disorderly conduct: 12 months probation and a $750 fine. Family violence simple battery: nolle prosequi.
•Michael Gurley, obstruction: 12 months probation less four days confinement and a $500 fine.
•Clinton Richard Rhodes, stalking and prowling: two years probation, psychosexual evaluation, no unsupervised contact with persons under 18 years of age, 6 a.m. to 6 p.m. curfew and a $1,250 fine. Reckless conduct: nolle prosequi.
•Phil Strown, simple assault: 12 months probation and a $400 fine.
•Patricia Carol Ginn, DUI less safe pled to lesser included offense of reckless driving: 12 months probation, 40 hours of community service and a $750 fine. Fleeing and attempting to elude, driving on wrong side of the roadway and weaving over roadway: nolle prosequi.
•Iriz Cardina Andrade, possession of less than one ounce of marijuana and reckless driving: 12 months probation, 40 hours of community service and a $1,000 fine. Carrying a concealed weapon: nolle prosequi.
•John Wiggins, theft by receiving stolen property: $250 fine.
•Gene Charles Oakes, two counts of contributing to the delinquency of a minor: two years in jail with credit for time served.
•Aaron Riley, first degree forgery: one year in prison and nine years probation. Battery: 12 months in jail. Additional count of first degree forgery: nolle prosequi.
•Morgan Lord, obstruction: $500 fine. •Stephen Michael Helms, family violence simple battery pled to non family violence simple battery: 12 months probation and a $500 fine.
•April Jones, theft by shoplifting and giving false name to a law enforcement officer: 12 months probation and a $1,000 fine. Giving false name or date of birth: nolle prosequi.
The following sentences were issued as part of negotiated plea agreements on August 4, 2010 with Superior Court Judge Joseph Booth presiding:
•Robert Joseph Peeples, possession of marijuana and possession of firearms by a convicted felon: ten years probation, three years prison suspended upon completion of intensive probation and a $2,000 fine.
•Adam Hudson, terroristic threats: five years serve 35 days with credit for time served, anger management and a $1,000 fine. Family violence simple battery: nolle prosequi.
•Christopher Michael Peppers, sale of cocaine: six years imprisonment, 24 years probation and a $1,000 fine.
•Joshua Allen Davis, theft by receiving stolen property: five years probation, $167 restitution and a $1,000 fine.
•Jacob Scott Kirkland, theft by receiving stolen property: first offender treatment, ten years probation, 100 hours of community service, restitution and a $1,000 fine.
•Nicholas Jade Green, burglary, entering auto and VGCSA: first offender treatment, seven years probation, restitution, five years to serve suspended upon completion of 40 weekends in jail with credit for time served and a $1,500 fine. Possession of less than one ounce of marijuana, and driving in violation of permit restrictions: nolle prosequi.
•Bobby Jerome Morrow, failure to register as a sex offender: ten years probation and a $1,000 fine.
•Joe Nathaniel Oliver, theft by taking: ten years probation, 90-120 days in a state detention center/ program, restitution and a $2,000 fine.
•Ronald Canady, financial transaction card theft, financial transaction card fraud and first degree forgery: five years probation and a $3,000 fine. Six counts of financial transaction card fraud: nolle prosequi.
•Timothy Steven Johnson, possession of less than one ounce of marijuana and giving false name: 12 months in jail with credit for time served.
•James Daniel Malpuss, theft by receiving stolen property pled to lesser included offense of criminal trespass: restitution and a $500 fine.
•Stanley Christopher Vaughn, theft by taking: 12 months probation and a $500 fine.
•Christopher William Martin, false report of a crime and driving without insurance: 12 months probation and a $1,000 fine.
•Charles David Allen, criminal trespass: 12 months probation and a $500 fine.
•Lamadre Tanner, disorderly conduct: 12 months probation and a $300 fine.
•Laura Porter, five counts of theft by taking: five years probation and restitution in the amount of $15,000.
•Michael James Martin, criminal trespass: 12 months probation less 15 days confinement and a $500 fine.
•April Marie Creswell, family violence simple battery: 12 months probation and a $500 fine. Theft by taking and criminal trespass: ten years probation. Four counts of first degree forgery and theft by deception: ten years probation, restitution and a $1,000 fine. One count of first degree forgery and two counts of theft by deception: nolle prosequi.
•April Christine Poore, two counts of simple battery: 12 months probation, 40 hours of community service and a $1,000 fine. Family violence battery: nolle prosequi.
•Lindsay Jordan Shepley, failure to report an accident, driving while license suspended, obstruction and giving false name to a law enforcement officer: three years probation less 30 days confinement, restitution and a $2,500 fine. Failure to maintain lane and using plate to conceal identification: nolle prosequi.
•Willie James McNair, family violence battery, two counts of family violence simple battery and interference with a 911 call: two years probation and a $1,000 fine.
