The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements on July 19, 2010 with Superior Court Judge Joseph Booth presiding:
•Jeremy Conner Ryan, aggravated battery and battery: first offender treatment, two years to serve suspended upon completion of four weekends in jail, ten years probation, 100 hours of community service, no contact with victim and a $1,000 fine. Two counts of aggravated assault: nolle prosequi.
•Kimberly Leslie Pilgrim, three counts of second degree forgery and theft by receiving stolen property: five years probation, restitution and a $2,000 fine.
•Anthony James Perry, aggravated battery and battery: first offender treatment, two years to serve suspended upon completion of four weekends in jail, ten years probation, 100 hours of community service, no contact with victim and a $1,000 fine. Two counts of aggravated assault: nolle prosequi.
•Joshua Woodard Muth, false imprisonment and reckless conduct pled to lesser included offense of family violence simple battery: two years probation and a $1,000 fine. Family violence battery, simple battery and third degree cruelty to children: nolle prosequi.
The following sentences were issued as part of negotiated plea agreements on July 21, 2010 with Superior Court Judge Currie Mingledorff presiding:
•Robert Todd Thomas, obstruction: 12 months confinement.
•Christopher Shawn Butler, possession of a substance with the intent to manufacture a controlled substance: three years to serve suspended upon completion of 65 days, ten years probation and a $1,500 fine. Possession of the tools for the commission of a crime: nolle prosequi.
•Jesus Garcia Delgado, possession of cocaine and DUI: four years probation, 40 hours of community service and a $1,500 fine. Additional count of DUI, underage possession of alcohol and driving while unlicensed: nolle prosequi.
•Phillip Butler, entering auto: first offender treatment, four years probation, 300 hours of community service, restitution, attend high school as required, graduate on schedule and pay a $500 fine. Theft by receiving stolen property: nolle prosequi.
•Warren Paul Henson, habitual violator and giving false name to a law enforcement officer: two years to serve suspended upon completion of six months of intensive probation, five years probation and a $2,000 fine. Failure to obey a traffic control device: nolle prosequi.
•Willie Tracy Wilson, two counts theft by taking: seven years probation, restitution and a $1,000 fine.
•Chet Joseph Bushey, family violence simple battery: 12 months probation and a $500 fine.
•Gabriel Laporta Moore, driving while license suspended, obstruction, speeding and giving false name: three years probation less 20 days confinement, 100 hours of community service and a $2,300 fine. Giving false date of birth to a law enforcement officer and license to be exhibited on demand: nolle prosequi.
•Robert Todd Thomas, second degree forgery, two counts of financial transaction card theft, two counts financial identity fraud, nine counts of criminal use of an article with an altered identification mark and five counts of theft by receiving: three years in prison, ten years probation, restitution and a $4,000 fine.
•Shawn Thomas Stokely, theft by taking and fleeing and attempting to elude: five years in prison, five years probation and restitution. Obstruction, hit and run, speeding and failure to stop at a stop sign: nolle prosequi.
•John Allen Dooley, VGCSA possession of methamphetamine and marijuana: three years to serve suspended upon the completion of residential substance abuse treatment and completion of aftercare program, complete risk reduction, attend four NA meetings each month for entire term of probation, serve 15 years probation, 40 hours of community service and a $3,250 fine.
•Derek Johnson, first degree forgery, theft by taking and criminal trespass: three years confinement, seven years probation, restitution and a $1,500 fine.
The following sentences were issued as part of negotiated plea agreements on July 22, 2010 with Superior Court Judge T. Penn McWhorter presiding:
•David Randall Pierce, terroristic threats and possession of a firearm by a convicted felon: five years probation, forfeit weapon and pay a $2,000 fine.
•Brian Christopher Stapleton, family violence battery and family violence simple battery: two years probation less two days confinement and a $1,000 fine.
•John Kaminski, theft by taking, obstruction and disorderly conduct: three days confinement, three years probation, 100 hours of community service, restitution and a $1,500 fine.
•Shane Destry Pilgrim Sr., family violence simple battery, interference with a 911 call and criminal trespass: two years probation, no violent contact with victim and a $1,500 fine.
•Dewayne Lon Sanders, obstruction: 12 months probation and a $500 fine.
•Michigan Moses Goldsby, disorderly conduct: 12 months probation and a $500 fine.
•Tina Mefs, obstruction: 12 months probation and a $500 fine to be suspended upon completion of 65 hours of community service.
•Carol Ann Sanders, possession of less than one ounce of marijuana: 12 months probation and a $750 fine.
•Barry Lee Wylie, simple battery: 12 months probation and a $300 fine.
•Janie Krett, disorderly conduct: 12 months probation and a $500 fine.
•Thaddeus Riden, criminal trespass: 12 months probation and a $500 fine.
•Mary Elizabeth Huggins, two counts of criminal trespass: two years probation, restitution and a $1,000 fine. Theft by taking: nolle prosequi.
•Jerry Estee McDonald, disorderly conduct: 12 months probation and a $500 fine.
•Nancy Jan Tode Ogden, too fast for conditions: 12 months probation and a $250 fine. Following too closely: nolle prosequi.
•Victor Scott Wilson, family violence battery, interference with a 911 call, third degree cruelty to children and criminal trespass: three years probation, no violent contact with victim, restitution and a $2,000 fine.
•Heidy Quinones Ellis, battery and criminal trespass: two years probation, no violent contact with victim and a $750 fine. Third degree cruelty to children: nolle prosequi.
•Richard Arnett, disorderly conduct: 12 months probation and a $500 fine.
•Betty Roxanne Yother, simple battery: 12 months probation less 20 days confinement and a $300 fine.
•Robert Calvin Nelson III, theft by taking and criminal trespass: two years probation, 50 hours of community service and no violent contact with victim. Additional count of criminal trespass: nolle prosequi.
•Lebron James Edward Smith, obstruction: 60 days in jail, ten months probation and a $500 fine.
•Adrian Rhodes, criminal trespass: 30 days in jail, 11 months probation and a $500 fine.
•Larry Joseph Hardigree, disorderly conduct: 40 days in jail, ten months and 20 days probation and a $400 fine.
•Floyd Williams, DUI less safe, open container and expired tag pled to lesser included offense of reckless driving: two years probation, 40 hours of community service and a $1,200 fine. Public intoxication and failure to change address on license: nolle prosequi.
•Jeffrey Alan Baughman, possession of less than one ounce of marijuana: 12 months probation and a $1,000 fine. Failure to stop at stop sign: nolle prosequi.
•Melissa Erin Doster, DUI per se, failure to maintain lane and open container: two years probation less 72 hours confinement, 240 hours of community service, ignition interlock device and a $1,500 fine. VGCSA and following too closely: nolle prosequi.
•Nicholas Atkinson, obstruction: 12 months probation and a $500 fine. Reckless conduct and false statements: nolle prosequi.
•Kayla Marie McCollum, obstruction: 12 months probation less 20 days confinement and a $500 fine.
•Carolyn Louis Johnson, burglary and giving false name to a law enforcement officer: one year in jail, nine years probation, restitution and a $1,500 fine.
•Tosha Lynn Archer, theft by shoplifting: first offender treatment, 12 months probation and a $500 fine.
•Tosha Lynn Holland, possession of methamphetamine and theft by taking: first offender treatment, ten years probation, restitution and a $1,000 fine. VGCSA and possession of a drug related object: nolle prosequi.
