Sentences issued in Superior Court June 8 - 10
The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements on June 8, 2010 with Superior Court Judge Joseph Booth presiding:
• Timothy Maurice Mayweather, obstruction: 12 months probation less 15 days confinement and a $500 fine.
• Robert Jerome Griffith, obstruction: seven days confinement.
• David Wesley Cody, entering auto: first offender treatment, two years probation, restitution and a $1,000 fine. Theft by taking: nolle prosequi.
• Jason Lee Carden, possession of methamphetamine, third degree cruelty to children, family violence battery and two counts of obstruction: One year suspended upon completion of residential substance abuse treatment program, eight years probation, no contact with victim and a $3,000 fine. Additional count of third degree cruelty to children, second degree cruelty to children, criminal trespass and interference with a 911 call: nolle prosequi.
• Alberta Sweat III, disorderly conduct and public intoxication: two years confinement with credit for time served.
• Martha Ann Watson, battery: 12 months probation less 20 days confinement and a $500 fine.
• Darenda Johnson, family violence simple battery: 12 months probation, no contact with victim and a $500 fine.
• Ray Martin Clark III, license not in possession, improper use and giving false identification: three years probation and a $1,500 fine. First degree forgery, obstruction and habitual violator: nolle prosequi.
• Jeffery Andreas Wyland, possession of marijuana: 12 months probation and a $1,000 fine. Family violence simple battery: 12 months probation less 30 days confinement and a $750 fine. Inmate possession of drugs or weapon: nolle prosequi.
• Michael Guy Harris, theft by taking, criminal trespass, suspended registration, driving without a license and open container: three years probation less 50 days confinement, 150 hours of community service and a $2,000 fine.
• Richard Allen Strickland Jr., giving false name: 12 months probation less 34 days confinement and a $500 fine.
• Alan Dean Hatton Jr., simple assault: 12 months probation, no violent contact with victim and a $500 fine. Disorderly conduct: nolle prosequi.
• Kimberly Bradford, possession of methamphetamine, possession of dihydrocodeine and no insurance: 15 years probation and a $2,000 fine. First degree forgery: two years confinement, eight years probation, restitution and a $1,000 fine. Financial identity fraud: two years confinement, eight years probation concurrent with other sentences, 100 hours of community service, restitution and a $1,000 fine. First degree forgery: two years confinement, eight years probation concurrent with other sentences, restitution and a $1,000 fine.
• Terry Wynn Green, possession of methamphetamine: ten years probation and a $1,000 fine.
• Trent Malone, sale of hydrocodone and sale of alprazolam: ten years probation, two years suspended upon completion of six months of work release and a $2,500 fine.
• Bobby Dwayne Martin, first degree forgery: three years confinement, seven years probation, restitution and a $1,000 fine.
• Jonathan Leonard Martin, criminal attempt trafficking in methamphetamine and four counts of possession of a firearm by a convicted felon: two years confinement, 13 years probation and a $3,000 fine.
• Jennifer Sue Stoops, first degree forgery: ten years probation, restitution and a $3,000 fine.

• Joshua Sheppard, sale of marijuana: first offender treatment, ten years probation and a $2,000 fine.

• Richard Atha, sale of morphine: ten years probation, 40 hours of community service and a $1,000 fine.
• David Charles Allen, aggravated assault and burglary: eight years probation, restitution and a $1,500 fine.
• Derrick Starks, sale of cocaine: ten years probation and a $1,000 fine. Two additional counts of sale of cocaine: ten years probation and a $2,000 fine.
• Judy Teresa Goheen, DUI less safe, possession of less than one ounce of marijuana, open container and speeding pled to the lesser included offense of reckless driving: 12 months probation, 80 hours of community service and a $1,600 fine.
• Jeffrey Shane Reed, battery and two counts of third degree cruelty to children: three years probation, 60 hours of community service and a $1,000 fine. First degree cruelty to children and three counts of false imprisonment: nolle prosequi.
• Antwon Scruggs, possession of marijuana with intent to distribute pled guilty to lesser included offense of misdemeanor possession of marijuana: 12 months probation and a $500 fine. Possession of oxycodone, possession of tools for the commission of a crime and possession of marijuana within 1,000 feet of a public park: nolle prosequi.
• Robert Goins, possession of marijuana with intent to distribute pled guilty to lesser included offense of misdemeanor possession of marijuana: 12 months probation and a $500 fine.
• Alvin Sanderson Jr., disorderly conduct: 12 months probation and a $500 fine.
• Marlo Kenneth Yarbrough, family violence simple battery: 12 months probation, no violent contact with victim and a $500 fine. False imprisonment: nolle prosequi.
• Narguitta Street, obstruction: 12 months probation and a $500 fine.
• Darren Smith, disorderly conduct: 12 months probation, no violent contact with victim and a $500 fine.
• Terry Wayne Smith, VGCSA: ten years probation and a $1,500 fine.
• Jennifer Lynn Gee, first degree forgery and identity fraud: three years probation and a $1,300 fine. Two counts of theft of lost or mislaid property: nolle prosequi.
• Jessica Deon Allen, possession of methamphetamine and theft by shoplifting: 11 years probation and a $2,000 fine.
• David Richards, burglary and possession of a sawed off shotgun: one year imprisonment, nine years probation, no contact with victims and a $2,000 fine.

• Ofelio Aguirre, DUI less safe and driving without a license: two years probation less 30 days confinement, ignition interlock device, turn in tags, habitual violator and a $1,500 fine. Open container, failure to maintain lane, impeding the flow of traffic and seatbelt violation: nolle prosequi.
• Jonathan Storey, DUI, reckless driving and speeding: two years probation less 14 days confinement, 80 hours of community service and a $2,000 fine. Fleeing and attempting to elude: nolle prosequi.
• Robert Steven Tuggle, DUI less safe and possession of less than one ounce of marijuana: 12 months probation, 40 hours of community service and a $1,000 fine.
• Ryan Basham, underage possession of alcohol: six months probation and a $300 fine. DUI less safe: nolle prosequi.
• Edward Hayes, DUI less safe: 12 months probation, 40 hours of community service and a $1,000 fine. DUI per se and failure to maintain lane: nolle prosequi.
• Paschal Rogue, following too closely and no license on person: 12 months probation and a $760 fine. Hit and run and giving false name or date of birth to a law enforcement officer: nolle prosequi.

• Samuel Charles Westburn, possession of marijuana and tail light violation: two years probation and a $1,250 fine. Two counts VGCSA, two counts of drugs to be kept in original container and tampering with evidence: nolle prosequi.
• Mark Douglas Fenley Jr., DUI per se and underage possession of alcohol: two years probation, 40 hours of community service and a $950 fine. Pills not in original container: nolle prosequi.
• Charles Brad Stephens, DUI drugs less safe: 12 months probation less 72 hours of confinement, 240 hours of community service and a $1,000 fine. DUI alcohol less safe: nolle prosequi.
