Alleged victim denies assault
A Barrow County Sheriff’s deputy temporarily detained a man accused of an assault, but released him after the victim denied any violence had occurred.
A deputy was dispatched to a Hwy. 124 business after a caller advised a female had been pushed to the ground. The caller said the female victim struck her head when she fell and was out in traffic on Hwy. 124.
When the deputy arrived, the caller said the victim had just left the scene with her assailant in a white, late model Buick with no tag.
The deputy caught up with the vehicle at Hwy. 124 and Flowery Branch Road and initiated a traffic stop.
The deputy ordered the alleged assailant out of the vehicle at gun point and placed him in handcuffs. The deputy advised the male that he was not under arrest, but was being detained during the investigation.
After the male was secured in the back of the deputy’s patrol car, the deputy spoke with the alleged victim. The victim said she and her boyfriend had been arguing about a previous girlfriend of his. The woman said they had pulled between two buildings to talk and, at one point, she “got upset and began crying hysterically.” The woman insisted nothing physical had occurred.
When the deputy spoke with the male, he gave the same story.
After checking to make sure neither the male nor female had any outstanding warrants, the deputy released the male and advised the couple a report would be written.
The deputy then returned to the Hwy. 124 business to speak with the initial complainant.
The complainant said she saw the white Buick pull between the two buildings at the location. A short time later, she saw the male and female talking when suddenly the female went backwards across the parking lot striking her head on concrete. The complainant said she did not actually see the male place his hands on the victim.
The complainant said the female then walked onto Hwy. 124 and laid down in a fetal position. The male left the scene and the complainant went to check on the female.
When the complainant asked if she needed an ambulance, the victim begged her not to call authorities. At that point, the male returned and the victim got back into the vehicle and left the scene.
The case is under investigation.
