Sentences issued in Superior Court April 20-22
The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements on April 20, 2010 with Superior Court Judge Currie Mingeldorff presiding:
• Peter Lighter Franchot, possession of a controlled substance: three years probation, 12 months inpatient treatment and a $750 fine. Possession with intent to distribute, possession of less than one ounce of marijuana, operating a vehicle without a valid tag, failure to maintain lane and tail light violation: nolle prosequi.
• Graham Stephen Sisk, theft by taking: ten years probation, two years suspended upon completion of comprehensive inpatient substance abuse rehabilitation, six months intensive probation, no contact with victims and a $1,000 fine.
• Edward Eugene Rice, theft by deception: five years probation, $1,000 in restitution and a $750 fine. Additional count of theft by deception and theft by taking: nolle prosequi.
• Michael Redding, three counts sale of marijuana and possession with intent to distribute marijuana: ten years probation, complete G.E.D. and obtain drivers license within 18 months and pay a $2,500 fine.
• Steven Andrew Smith, possession of marijuana more than one ounce: seven months confinement, four years and five months probation, substance abuse treatment and a $1,000 fine.
• Teresa Cindy Grailey, theft by shoplifting and possession of alprazolam: five years probation, no contact with victim, six to 12 months of comprehensive inpatient substance abuse rehabilitation and a $1,000 fine.
• Ronald Leon O’Neal, first degree forgery: eight years probation, 60 hours of community service and a $750 fine. Possession of hydocodone and obtaining a controlled substance by fraud: nolle prosequi.
• James Edwin Wise, possession of alprazolam and DUI less safe: eight years probation less 24 hours confinement, 40 hours of community service, 90 hours suspended upon intensive probation, DUI risk reduction and a $1,000 fine. Reckless driving and drugs to be kept in original container: nolle prosequi.
• Melvin Gray, distribution of cocaine: two years confinement, 13 years probation, substance abuse treatment and a $3,000 fine.
• Kendavious D. Smith, possession of cocaine and theft by receiving: five years probation, two years confinement suspended upon completion of 120-180 days in state detention center program, substance abuse treatment, restitution and a $1,000 fine. Seatbelt violation: nolle prosequi.
• Deanna Avery, theft by receiving: first offender treatment, 12 months probation, testify truthfully against co-defendants, $200 restitution and a $500 fine.
• Carlton Cobra Dyer, burglary: 12 months probation, $250 in restitution and a $500 fine. Second degree criminal damage to property: nolle prosequi.
• Lindsay Royster, obstruction: 12 months probation, 40 hours of community service and a $750 fine.
• John Curtis Brooks, battery: 12 months probation, no violent contact with victim and a $500 fine.
• Robert Chase Royster, obstruction, criminal trespass and possession of less than one ounce of marijuana: first offender treatment, 12 months probation, 40 hours of community service and a $1,500 fine. Additional count of obstruction: nolle prosequi.
• Carlos M. Salinas, family violence battery and third degree cruelty to children: two years probation less three days confinement, no violent contact with victim, parenting classes and a $1,000 fine. Two counts of aggravated assault and an additional count of cruelty to children: nolle prosequi.
• Kelsey Reed Armbruster, possession of less than one ounce of marijuana: first offender treatment, 12 months probation and a $750 fine. Possession of a controlled substance and possession with intent to distribute: nolle prosequi.
The following sentences were issued as part of negotiated plea agreements on April 22, 2010 with Superior Court Judge T. Penn McWhorter presiding:
• David H. Weidler, reckless driving: $1,000 fine.
• Dianne Criswell, battery and obstruction: 12 months probation less 30 days confinement, 100 hours of community service, no contact with victim and a $500 fine. Suspended license, hit and run and possession of less than one ounce of marijuana: three years probation less three days confinement, restitution and a $2,750 fine. DUI less safe and suspended license: two years probation less 30 days confinement, 240 hours of community service, risk reduction and a $3,000 fine. Disorderly conduct, third degree cruelty to children and false report of a crime: nolle prosequi.
• Richard Lee Brown, criminal trespass: 12 months probation and a $500 fine. Simple assault: nolle prosequi.
• Cynthia Rudell, four counts of theft by taking: 12 months probation less 47 days confinement and a $500 fine.
• Ernest Cooper, theft by shoplifting: 12 months probation less 70 days confinement, alcohol and drug treatment and a $500 fine.
• Billy Gene Sims, disorderly conduct: 12 months probation, anger management, no contact with victim and a $500 fine. Battery: 12 months probation less 18 days confinement, anger management, no contact with victim and a $500 fine.
• Ryan Keith Hudgins, disorderly conduct: 12 months probation and a $500 fine. Family violence simple battery: nolle prosequi.
• Lonnie Edward Cloer, DUI: 12 months probation, 40 hours of community service, risk reduction, alcohol and drug treatment and an $800 fine. Speeding: nolle prosequi.
• Jonathan Randall Adams, battery: 12 months probation less four days confinement, no violent contact with victim and a $500 fine.
• Joel Raymond Wilkes, possession of less than one ounce of marijuana: 12 months probation, alcohol/drug treatment, defensive driving and a $750 fine.
• Stacey Dewayne Peppers, simple battery: 12 months probation, alcoholics anonymous attendance and a $500 fine.
• Jason Randall Allen, DUI, child endangerment and speeding: two years probation less 24 hours confinement, 40 hours of community service, risk reduction, alcohol/drug treatment and a $2,000 fine.
