The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements on Feb. 25, 2010 with Superior Court Judge T. Penn McWhorter presiding:
• Stephen Daugherty, speeding: $300 fine.
• Terry Luchian, theft by taking: 48 hours confinement.
• Stephen Kalvelaye, affray: $300 fine.
• Daniel Francis Kelly III, theft by receiving stolen property: five months jail.
• Julie Graham Corman, deposit account fraud: 60 days confinement, one year and ten months probation, $2,400 in restitution and a $500 fine.
• Marquez Dabonta Johnson, possession of cocaine and possession of cocaine with intent to distribute: three years confinement, 27 years probation and a $4,000 fine. Sale of cocaine: three years confinement and 27 years of probation plus a $2,500 fine.
• Randall Hollis, criminal trespass: 30 days confinement, 11 months probation and a $600 fine. Two additional counts of criminal trespass: nolle prosequi.
• Amber Jeanette Smith, family violence battery, cruelty to children third degree and criminal trespass: three years probation less 40 days confinement, no contact with victim and a $1,300 fine.
• James Allen Harvey, disorderly conduct and criminal trespass: two years probation less 25 days confinement and a $1,250 fine.
• Aaron Francis Lowe, DUI: 90 days confinement, nine months probation, 40 hours of community service and a $700 fine. Possession of oxycotone, drugs to be kept in original container, failure to maintain lane and too fast for conditions: nolle prosequi.
• Tavarus Lamar Newton, simple battery and criminal trespass: two years probation and a $500 fine.
• Jacob Gregory Orr, criminal trespass: 12 months probation, no violent contact with victim and a $500 fine. Family violence simple assault: nolle prosequi.
• Dennis Wendell Collins, possession of a drug related object and driving while license suspended: two years probation and a $1,500 fine. Open container and seatbelt violation: nolle prosequi.
• Brandon David McDaniel, family violence battery: 12 months probation, no contact with victim and a $500 fine.
• Amberly Lynn Knight a.k.a. Amberlee Lynn Ayers, family violence battery: 12 months probation less 28 days confinement, no violent contact with victim and a $500 fine.
• Jeffrey Allen Maddox, obstruction of a law enforcement officer: 12 months probation and a $300 fine.
• James Richard Coggins, reckless driving: 12 months probation, 40 hours of community service and a $750 fine. Failure to maintain lane and following too closely: nolle prosequi.
• Vincent Lee Moore, failure to stop at stop sign, giving false name, driving without a license and criminal trespass: two years probation and a $1,500 fine. Obstruction and reckless driving: nolle prosequi.
• Bradley Robert Pendley, simple battery: 12 months probation, no violent contact with victim and a $500 fine.
• Britton A. Barr, battery: 12 months probation, no violent contact with victim and a $500 fine. Family violence simple battery and disorderly conduct: nolle prosequi.
• Mash Hunda, DUI less safe: 12 months probation, 80 hours of community service and a $1,000 fine.
• Johnny Dean Stewart, DUI per se and failure to maintain lane: 12 months probation less 24 hours confinement, 40 hours of community service and a $1,250 fine. DUI less safe and open container: nolle prosequi.
• Princess Leashley Gaines, DUI per se: 12 months probation less 72 hours confinement, 240 hours of community service and a $1,000 fine. DUI less safe and driving without license on person: nolle prosequi.
• Lindsay Douglas Branch, reckless driving: 12 months probation, 40 hours of community service and a $1,000 fine.
• Charles E. Russell, driving without a license: 12 months probation and a $500 fine. Driving while license suspended: nolle prosequi.
• Christopher Brett Morgan, DUI less safe: 12 months probation less 24 hours confinement, 40 hours of community service and a $750 fine. Driving an improperly equipped vehicle: nolle prosequi.
• Sondra Conner, family violence battery (pled guilty to lesser included offense of disorderly conduct) and criminal trespass: 12 months probation, restitution and an $8000 fine. Two counts of third degree cruelty to children: nolle prosequi.
• Eric Paul Johnson, reckless driving, driving without a license, failure to maintain lane and operating a vehicle without a valid tag: three years probation, 40 hours of community service and a $1,850 fine. DUI less safe and no insurance: nolle prosequi.
• Ignacio Juarez, reckless driving and driving without a license: 12 months probation, 40 hours of community service and a $1,250 fine.
• Jeffrey Lynn Johnson, DUI and open container: 12 months probation less six days confinement, 240 hours of community service and a $1,200 fine.
• Donna Jeffries, reckless driving: 12 months probation, 40 hours of community service and a $750 fine. Failure to maintain lane: nolle prosequi.
• William Stanley Delaney, DUI drugs (pled guilty to lesser included offense of reckless driving): 12 months probation and a $750 fine. Improper turn: nolle prosequi.
• Ashley Mosley, family violence battery: 12 months probation and a $500 fine.
• Tony Ben Moua, carrying a concealed weapon and disorderly conduct: two years probation, no contact with victim and a $1,000 fine. First degree cruelty to children, two counts of aggravated assault and possession of a firearm during the commission of a crime: nolle prosequi.
• David Eugene Montgomery, reckless driving and speeding: 12 months probation and an $850 fine. Suspended registration, failure to change license information and driving without headlights: nolle prosequi.
• Pao Ge Moua, carrying a concealed weapon and disorderly conduct: two years probation, 40 hours of community service, no contact with victim and a $1,000 fine. First degree cruelty to children, two counts of aggravated assault and possession of a firearm during the commission of a crime: nolle prosequi.
• Walter Meeks, interference with a 911 call: 12 months probation and a $500 fine. Family violence simple battery: nolle prosequi.
• Manuel Landeverde, two counts of family violence simple battery: two years probation, no violent contact with victim and a $1,000 fine. Two additional counts of family violence simple battery: nolle prosequi.
• Robert Lee Watson, family violence battery: 12 months probation, no violent contact with victim and a $750 fine. Five counts of third degree cruelty to children: nolle prosequi.
• James Daniel Sanders Jr., family violence battery, battery and third degree cruelty to children: two years probation, no violent contact with victim and a $1,000 fine. Additional count of third degree cruelty to children: nolle prosequi.
