The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentence was issued as part of negotiated plea agreement on Jan. 27, 2010 with Superior Court Judge Joseph Booth presiding:
• Tommy Chandler, two counts sale of cocaine: eight years confinement, 22 years probation and a $2,500 fine.
The following sentences were issued as part of negotiated plea agreements on Feb. 4, 2010 with Superior Court Judge David Motes presiding:
• Charles Anthony Barnes Jr., possession of cocaine and marijuana with intent to deliver: fifteen years probation and a $4,000 fine.
• Richard Louis Delorier Jr., theft by taking motor vehicle and theft by taking: ten years probation less 120 days confinement, $2,500 in fines and $540 in restitution.
• Julia Louise Duane, first degree arson: first offender treatment, ten years probation and a $5,000 fine.
• Randy Joe Brown, aggravated battery, aggravated assault and battery: One year and ten months confinement, 18 years and two months probation, no contact with victim and a $2,000 fine.
• Jason Richard Hopkins, possession of a controlled substance and obstruction: eight years probation and a $2,500 fine.
• Joanne Guinn Ballew, possession of methamphetamine: first offender treatment, five years probation and a $1,500 fine.
• Gerald Jerome Harris, first degree forgery, driving while licenses suspended, giving false information to a law enforcement officer and speeding: first offender treatment, ten years probation and a $3,750 fine.
• Evelyn Marie Billings, possession of cocaine with intent to distribute and criminal attempt to sell cocaine: first offender treatment, 15 years probation and a $2,500 fine.
• John Wyndell Hughes, aggravated assault against a police officer, DUI, fleeing and attempting to elude, reckless driving, obstruction, criminal trespass, failure to maintain lane and operating a vehicle without a valid tag: 15 years (three years suspended upon eight months to serve CTS, six months intensive probation and other conditions), 240 hours of community service and a $5,000 fine.
• Terry Chad Helton, VGCSA methamphetamine and driving while license suspended: first offender treatment, ten years probation and a $2,000 fine. No proof insurance and window tint violation: nolle prosequi.
• Ronald Justin Dukes, sale of methamphetamine: 15 years probation, 100 hours of community service and a $2,000 fine. Possession of alprazolam with intent to distribute: ten years probation, 100 hours of community service and a $2,000 fine.
• Denver Scott Heifner, possession of alprazolam, DUI, possession of less than one ounce of marijuana and open container: first offender treatment, three years probation, 40 hours of community service and a $2,000 fine.
• Lawrence Harris, aggravated assault, cruelty to children and simple battery: 15 years probation, no violent contact with victims and a $3,000 fine. Terroristic threats and a second count of cruelty to children: nolle prosequi.
• Jamarcus Watson, armed robbery: first offender treatment, 15 years probation less 180 to 220 days confinement, no contact with victim, $380 in restitution and a $2,500 fine.
• Enrique Virrueta Flores, trafficking and sale of methamphetamine: ten years confinement, ten years probation and a $200,000 fine.
• John Wayne Farley, possession of oxycodone: three years probation and a $2,000 fine.
• Jared Douglas Breshers, aggravated assault and battery: first offender treatment, 15 years probation, no violent contact with victim and a $1,500 fine. Additional count of aggravated battery, false imprisonment, simple battery and three counts of cruelty to children: nolle prosequi.
• Dana Nicole Smith, five counts of obtaining a controlled substance by fraud: first offender treatment, eight years probation, 40 hours of community service, no contact with co-defendant and a $4,500 fine.
• Glenn Harris, possession of cocaine: five years probation and a $1,000 fine.
• William Timothy Hardigree, terroristic threats and acts: 12 months probation and a $500 fine.
• Cga Lee Thao, two counts of aggravated assault: 15 years probation, no contact with victim and a $2,000 fine.
• Matthew Charles Harmon, burglary, nine counts entering auto: burglary charge reduced to lesser included offense of criminal trespass, five years probation, 300 hours of community service, $293 restitution and a $3,000 fine. Two counts theft by taking: nolle prosequi.
• Robert McCline Holcombe Jr., battery and simple assault: 12 months probation, no contact with victim and a $500 fine.
• Donald Thomas Freeman, two counts criminal damage to property: pled guilty to lesser included offense of criminal trespass, 12 months probation, no contact with victim, $3,086 in restitution and a $2,000 fine.
• Benny Lewis Delay Jr., disorderly conduct: 12 months probation, no violent contact with victim and a $500 fine. Terroristic threats and acts: nolle prosequi.
• Jerry Parks Harrison, theft by receiving stolen property: 12 months probation, $250 in restitution and a $500 fine.
• Terry Herndon, possession of cocaine: five months confinement, seven months probation and a $500 fine. Possession of oxycodone: nolle prosequi.
• Terry Mickle, possession of a drug related object: one month confinement and 11 months probation. Possession of cocaine and oxycodone: nolle prosequi.
• Ashleigh S. Berryman, criminal attempt to acquire dangerous drugs: 12 months probation and a $1,000 fine. First degree forgery: nolle prosequi.
• Vickie Marksbury, possession of cocaine and oxycodone: charges reduced to lesser included offense of possession of a drug related object, 12 months probation and a $1,000 fine.
• Cecilia Delgado, theft by shoplifting: 11 months probation and a $500 fine.
• Michael Shane Bell, disorderly conduct and pointing a gun at another: 12 months probation, no contact with victim and a $750 fine.
• Thomas Alex Harmon, burglary: charge reduced to lesser included offense of criminal trespass, first offender treatment, 12 months probation, no contact with victim and a $500 fine. Aggravated stalking and obstruction: aggravated stalking charge reduced to lesser included offense of violation of a temporary protective order, two years probation, 20 hours of community service, no contact with victim and a $1,000 fine. Violation of a family violence order: nolle prosequi.
• Kevin Elrod Kietaber, criminal damage to property, two counts battery, simple battery and theft by taking: five years probation, no contact with victim and a $2,500 fine.
• Kevin Brent Burgess, aggravated stalking: pled guilty to lesser included offense of harassing phone calls, 12 months probation, no violent contact with victim and a $500 fine.
• Julie Graham Cotman, DUI less safe and driving while license suspended: two years probation less 40 days confinement, 240 hours of community service and a $2,500 fine.
• Jonathan Buchanan, terroristic threats and acts and possession of less than one ounce of marijuana: terroristic threats charge reduced to lesser included offense of disorderly conduct, 12 months probation, no contact with victim and a $1,000 fine. Two counts of family violence battery: nolle prosequi.
• Charles Change Soo Kim, battery: pled guilty to lesser included offense of simple battery, 12 months probation and a $500 fine. Aggravated assault: nolle prosequi.
