The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements on Jan. 19, 2010 with Superior Court Judge T. Penn McWhorter presiding:
• Samban Hang, simple battery: 12 months probation less 24 hours confinement, no contact with victim and a $750 fine.
• Susan Maria Rapp, DUI less safe and DUI per se: 12 months probation less 72 hours confinement, 240 hours of community service, ignition interlock device and a $1,000 fine. Failure to maintain lane: nolle prosequi.
• John Avery Marrell Jr., speeding: 12 months probation and a $300 fine. DUI less safe and DUI per se: nolle prosequi.
• Shawn Raye Wonderlie, two counts of DUI: 12 months probation less 24 hours confinement, 40 hours of community service and a $750 fine. Criminal trespass: nolle prosequi.
• Benny Lewis Delay Jr., battery and obstruction: 12 months probation, no contact with victim and a $750 fine.
• Benjamin Scott, DUI per se: 12 months probation, 40 hours of community service and a $1,000 fine. DUI less safe and weaving over roadway: nolle prosequi.
• Cassie Marie Richey, DUI, DUI less safe and weaving over roadway: 12 months probation, 40 hours of community service and a $1,250 fine.
• Madison Brooke Simmons, DUI less safe and possession of less than one ounce of marijuana: 12 months probation less 72 hours confinement, 240 hours of community service and a $1,500 fine. Possession of alprazolam, consumption of alcohol under the age of 21, failure to maintain lane, drugs to be kept in original container and tail light violation: nolle prosequi.
• Barry D. Bates, giving false information to a law enforcement officer: 12 months probation and a $500 fine.
• Kenneth Shane Prickett, DUI less safe and possession of less than one ounce of marijuana: two years probation, 40 hours of community service plus a $1,500 fine.
• Royce Walter Whitlaw, DUI: 12 months probation less 24 hours confinement, 40 hours of community service and $1,000 fine. Expired tag, no proof of insurance, no registration and tail lights required: nolle prosequi.
• Jerry Dakhota McCranie, obstruction: 12 months probation less 20 days confinement and a $250 fine.
• Rodney N. Norris, simple battery, DUI less safe, open container and driving while unlicensed: Four months confinement, eight months probation, 40 hours of community service and a $1,050 fine. Family violence battery, reckless driving and failure to maintain lane: nolle prosequi.
• Reynaldo Reynaga, family violence battery: Ninety-nine days in jail, 266 days probation, no contact with victim and a $1,000 fine. Family violence simple battery: 12 months probation, no contact with victim and a $500 fine.
