The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements with Superior Court Judge Joseph Booth presiding:
• Andre Julius Samples, possession of cocaine, fleeing, obstruction, suspended license, DUI, no signal, suspended registration and failure to obey a traffic control device: two years confinement.
• Herbert Edward Lee, possession of hydrocodone: four years probation and a $1,000 fine. Two counts of fraudulently obtaining a controlled substance: nolle prosequi.
• Chris Franco, statutory rape: 12 months probation less 45 days confinement, no contact with victim and a $500 fine.
• Kimberly Dale Epps, giving false information to a law enforcement officer: 28 days confinement.
• Alicia Ryan Pierce, theft by deception: one year probation, no contact with victim and a $500 fine. Reckless conduct: one year probation, no contact with victim and a $500 fine. Criminal trespass and simple battery: two years probation, no contact with victim and a $1,000 fine. False report of a crime: one year probation, no contact with victim and a $500 fine. Violation of a family violence order, false statements and two counts of criminal trespass: nolle prosequi.
• Gary Wayne Studstill, fleeing and attempting to elude and driving while license suspended: one year probation less ten days confinement plus a $1,000 fine.
• Anthony M. Strickland, third degree cruelty to children and family violence battery: one year probation and a $500 fine.
• Nicholas Alexander Atkinson, simple battery: one year probation, no violent contact with victim and a $500 fine. Two counts of third degree cruelty to children: nolle prosequi.
• Tom Couch, violation of a temporary protective order: 12 months probation, no contact with victim and a $500 fine.
• Richard Davenport, criminal trespass: 12 months probation less 45 days confinement and a $500 fine.
• Russell Marquise Barnes, battery of a pregnant woman: two years probation, no violent contact with victim and a $1,000 fine.
The following sentence was issued as part of a negotiated plea agreement with Superior Court Judge Currie Mingledorff presiding:
• Kelly Rose Shierling, possession of methamphetamine: two years confinement.
The following sentence was issued as part of a negotiated plea agreement with Superior Court Judge T. Penn McWhorter presiding:
• Donald Ervin Richmond, DUI drugs, DUI less safe and weaving over roadway: one year probation less 24 hours confinement, 40 hours of community service and a $1,500 fine.
