The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements during the past week with Superior Court Judge T. Penn McWhorter presiding:
• James Allen Shepherd, abandonment of dependent child: 60 days to serve suspended upon child support payment of $1,000.
• Marshon Barnes, obstruction: $300 fine.
• Justin Lawrence Jernigan, reckless driving, driving without a license and fleeing and attempting to elude: three years probation, 40 hours of community service and a $2,000 fine. No insurance, failure to stop for stop sign and an additional count of reckless driving: nolle prosequi.
• Derek Standridge, DUI per se: 12 months probation, 40 hours of community service and an $850 fine. DUI less safe: nolle prosequi.
• Kenneth Jarrell, child abandonment: 12 month sentence suspended upon payment through child support recovery.
• Calvin Jamain Cunningham, family violence simple battery: one year probation, no violent contact with victim and a $500 fine.
• Kerri Ann Patton, failure to maintain lane, DUI and hit and run: two years probation, 40 hours of community service and a $1,8000 fine.
• Blaize Brawndale, driving while license suspended, obstruction and hit and run: one year probation and a $1,750 fine. Reckless driving: nolle prosequi.
• William Scott Kirkland, driving while license suspended: 12 months probation less 48 hours confinement plus a $750 fine. Equipment violation: nolle prosequi.
• William James Adkinson, DUI: 12 months probation and a $1,000 fine.
• Timothy James Mutcher, DUI per se and following too closely: 12 months probation less one day confinement, 40 hours of community service and a $750 fine.
• Desiree May Merrick, driving while license suspended: 12 months probation and a $750 fine. Failure to dim headlights: nolle prosequi.
• Daniel Patrick Behen, DUI per se and DUI less safe: 12 months probation less 24 hours confinement, 40 hours of community service and a $1,000 fine.
• Dedrea Cher Vick, DUI: 12 months probation, 40 hours of community service and a $1,000 fine. Failure to maintain lane: nolle prosequi.
• Kimberly Ruark, obstruction: 12 months probation and a $500 fine.
• Thaddius Jermaine Brauner, obstruction: 30 days confinement, 11 months probation and a $500 fine.
• Andrew Christopher Stephens, harassing phone calls: 12 months probation, no contact with victim and a $500 fine.
• Jennifer Margaret Gaddis, weaving over roadway: 12 months probation and a $500 fine. DUI less safe: nolle prosequi.
• Timothy Stapp, family violence simple battery: 12 months probation and a $500 fine.
• Kimberly Russo James, aggressive driving and reckless conduct: two years probation, no violent contact with victim and a $1,500 fine.
• Kenneth Ryan Lee, battery and criminal trespass: two years probation less 30 days confinement, no contact with victim and a $1,000 fine.
• Christopher Dukes, possession of marijuana with intent to distribute and possession of more than one ounce of marijuana: one year confinement, nine years probation and $3,500 fine.
• Judith Paige Edwards, possession of a non-controlled substance with intent to distribute and possession of a firearm during the commission of a crime: first offender treatment, ten years probation and a $1,000 fine. Possession of drug related objects: nolle prosequi.
• Walter Zagorski, two counts of burglary: five years confinement, 15 years probation, no contact with victim, restitution and a $2,000 fine. Terroristic threats: five years probation, no contact with victim and a $1,000 fine. Two additional counts of burglary, family violence battery and criminal trespass: nolle prosequi.
• Augustine Lara, terroristic threats: five years probation, no violent contact with victim and a $1,000 fine. Two counts of third degree cruelty to children: nolle prosequi.
• Royce Clarke Campbell, failure to register as a sex offender: 18 months confinement, eight years and six months of probation plus a $1,000 fine.
• Dexter Lanier Brown, possession of marijuana with intent to distribute and possession of cocaine: One year confinement, nine years probation and a $2,000 fine.
• Samuel Teasley, theft by receiving stolen property and theft by shoplifting: Six years confinement, four years probation, restitution and a $1,500 fine. Financial transaction card theft and fraud: three years probation and restitution. Four counts of entering auto, possession of dihydrocodeine and criminal trespass: nine years probation, restitution and a $3,500 fine. Obstruction, theft by taking, pedestrian under the influence and driving while license suspended: nolle prosequi.
• Frederick Kutchinsky, forgery, false swearing, fraud and false information documents: ten years probation, restitution and a $3,000 fine. First degree forgery and two counts of giving false or misleading statements: ten years probation, restitution and a $3,000 fine. Two counts of forgery, one count of false swearing, two counts of fraud, one count of false information document, three counts of obstruction and giving false name: nolle prosequi.
