Sentences issued in Superior Court
The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements on Dec. 2, 2009 with Superior Court Judge David Motes presiding:
• James Kobialka, VGCSA possession of hydrocodone: three years probation plus a $1,000 fine. VGCSA possession of methamphetamine: nolle prosequi.
• James Franklin Fix, two counts of first degree forgery: ten years probation less one month and four days confinement, $2,000 in restitution and $1,000 fine suspended upon payment of restitution. Additional count of first degree forgery and theft by taking: nolle prosequi.
• Matthew Scott Gunter, terroristic threats and acts: first offender treatment, two years probation, no contact with victim and a $1,000 fine. Simple assault: nolle prosequi.
• Shon Alexander Pope: VGCSA possession of cocaine: one year confinement, nine years probation and a $1,000 fine.
• Denver Ryan Harrison, simple battery: 12 months confinement.
• Fred Lee Tyler, first degree forgery: first offender treatment, five years probation and a $1,000 fine.
• Timothy Shane Crews, VGCSA possession of methamphetamine: six years probation and a $1,500 fine. Possession of drugs within guard line: nolle prosequi.
• Colby Jacob Knight, VGCSA possession of Alprazolam with intent to distribute and theft by shoplifting: ten years probation and a $2,500 fine. Pills not in original container and misdemeanor marijuana possession: nolle prosequi.
• Derrick Lamonte Rucker, obstruction, terroristic threats and false imprisonment: five years probation, no contact with victim and $2,500 in fines.
• James Kennedy Hayes, VGCSA sale of cocaine: three years confinement, 17 years probation and a $4,000 fine. DUI and weaving across roadway: 12 months probation, 40 hours of community service and a $750 fine.
• Melinda Kay Bunn, simple battery, 12 months probation, no contact with victim and a $500 fine. Family violence battery: 12 months probation, no contact with victim and a $500 fine. Additional count of family violence battery: nolle prosequi.
• Jason Monroe Mitchell, giving false name or information to a law enforcement officer: 12 months probation and a $500 fine. Open container: nolle prosequi.
• Derrick Justin Mayweather, theft by taking and obstruction: one year probation less 90 days confinement plus a $1,000 fine. Possession of drug related objects and an additional count of obstruction: nolle prosequi.
• Kyle Foster Duke, disorderly conduct: 12 months probation and a $500 fine. Second count of disorderly conduct: nolle prosequi.
• Mitchell James Davis, affray, disorderly conduct and criminal trespass: 12 months probation, no contact with victim and a $500 fine.
• Jessica Eldridge: disorderly conduct: 12 months probation and a $500 fine. Simple assault: nolle prosequi.
The following sentences were issued as part of negotiated plea agreements on Dec. 3, 2009 with Superior Court Judge T. Penn McWhorter presiding:
• Jack Mabry Chapman, speeding: $250 fine.
• Lisa Kay Parks Huff, battery: 12 months probation, no violent contact with victims and a $500 fine. Three counts of cruelty to children: nolle prosequi.
• Larry Joseph Hardigree, criminal trespass: 12 months probation, no violent contact with victim and a $750 fine.
• Alexa Oscar Ballard, driving while license suspended: 12 months probation and a $750 fine.
• Thomas Jake Malcolm, obstruction: 12 months probation and a $500 fine.
• Pamela Johnson, criminal trespass: 12 months probation less 16 days confinement, no contact with victim and a $750 fine.
• Clifford Lee, theft by shoplifting and criminal trespass: 12 months probation and a $500 fine.
• Tracey Rena Cooper, DUI and failure to maintain lane: 12 months probation less 72 hours confinement plus $1,300 in fines. DUI less safe and failure to use correct signal: nolle prosequi.
• James Randy Andrews, reckless driving, fleeing and attempting to elude, driving with a suspended license, failure to obey traffic control device, equipment violation and using license plate to conceal identification: six months confinement followed by six months probation and a $500 fine.
• Christopher Baessler, criminal trespass: 12 months probation, restitution and a $500 fine. Disorderly conduct: nolle prosequi.
• Joshua Preston Craft, second degree vehicular homicide: 12 months probation and a $1,000 fine.

• Anand Ram Swamy, DUI per se, DUI less safe, DUI drugs, weaving and license not on person: 12 months probation less 15 days confinement, 240 hours of community service and a $1,500 fine.
• Larry Linton Beckum, DUI and failure to maintain lane: 12 months probation, 20 hours of community service and a $1,500 fine. License not on person: nolle prosequi.
• Mitchell Dean Wilkerson, DUI drugs: 12 months probation, 40 hours of community service and a $750 fine.
• Shirley Hall Cronic, DUI less safe and failure to maintain lane: 12 months probation and $1,050 fine.
• Beverly Jean Rasler, DUI and failure to obey traffic control device: 12 months probation, 40 hours of community service and a $1,000 fine.
• Michael Leonard McCoy, two counts of making a false statement for an insurance claim: 12 months probation, 40 hours of community service and a $2,000 fine.
• April Michelle Williams, fleeing and attempting to elude, reckless conduct, destruction of mailbox and reckless driving: two years probation and a $2,000 fine. Speeding and weaving over roadway: nolle prosequi.
