The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements on November 16, 2009 with Superior Court Judge Joseph Booth presiding:
• William Pete Bachelor, possession of methamphetamine with intent to distribute and possession of cocaine: four years confinement, eight years probation and a $1,500 fine.
• Vickey Sue Smith, two counts of theft by receiving stolen property and two counts of theft by deception: two years probation, restitution and a $1,000 fine. Seventeen counts of financial transaction card fraud: six years probation, $2,080 in restitution and two years confinement suspended upon successful completion of Residential Substance Abuse Treatment (RSAT).
The following sentences were issued as part of negotiated plea agreements on November 23, 2009 with Superior Court Judge T. Penn McWhorter presiding:
• William Simmons, theft by conversion: two years probation, $500 fine and restitution of $1,353.
• Robert Flanagan, criminal trespass: one year probation, no contact with victim and a $500 fine. Possession of methamphetamine and disorderly house: five years probation, no contact with victim and a $2,000 fine. Possession of imitation controlled substance: nolle prosequi.
• Kevin Burgess, child abandonment, 12 months in jail suspended upon successful completion of work release.
• Rosalie Hope May, public drunkenness and disorderly conduct: 12 months probation and an $800 fine. Simple battery: nolle prosequi.
• Courtney Kathryn Dimler, theft by shoplifting and criminal trespass: two years probation less ten days confinement, 60 hours of community service and a $1,000 fine.
• Lori Meeks Moon, DUI, suspended license and possession of marijuana: two years probation less 25 days confinement, 240 hours of community service and a $2,250 fine. Drugs to be kept in original container and driving without headlights: nolle prosequi.
• Joseph Lee Brown, family violence battery, family violence simple battery, giving false information to a law enforcement officer and obstruction of a law enforcement officer: two years probation less 24 days confinement, no contact with victim and a $1,200 fine.
• James Mack Dodd, harassing phone calls, 12 months probation less 15 days confinement, 40 hours of community service, no contact with victim and a $500 fine.
• Christopher Canup, simple battery: 12 months probation less 22 days confinement, no contact with victim and a $500 fine. Battery: nolle prosequi.
• Jason Carl Holbrook, DUI, suspended license, hit and run, obstruction and failure to maintain lane: five years probation less 30 days confinement, 240 hours of community service and a $1,750 fine. Theft by taking motor vehicle and too fast for conditions: nolle prosequi.
• Lanny Nelson Williams, criminal trespass, 12 months probation and a $500 fine.
• David Paul Richards, criminal trespass and criminal damage to property: 12 months probation, no contact with victim, restitution of $747 and a $500 fine.
• Cody Jacob Barrett, public indecency, one year probation, no contact with victims and $500 fine.
• Carlos Jesus Cortez, DUI, suspended license and obstruction: three years probation less 90 days confinement, 240 hours of community service and $4,000 fine. False identification document, DUI less safe, giving false information to a law enforcement officer and no tag light: nolle prosequi.
• Miriam Elizabeth Elliston, reckless driving: 12 months probation, 60 hours of community service and $1,000 fine. DUI less safe and failure to dim headlights: nolle prosequi.
• John Stanley Cunningham, speeding: 12 months probation and $500 fine. DUI per se and DUI less safe: nolle prosequi.
• Jimmy Harlan Maughon, disorderly conduct, 12 months probation, no contact with victim and $500 fine.
