Sentences issued in Superior Court
The Barrow County Superior Court recently sentenced the following people. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements on November 6, 2009 with Superior Court Judge David Motes presiding:
• Joseph Housmer, possession of a firearm by a convicted felon: 90 days confinement, four years, nine months probation and $1,000 fine.
• Sean Xavier Hogan, family violence battery and interference with government property: two years confinement, eight years probation, no contact with victim, restitution and $2,000 fine. False imprisonment and cruelty to children: nolle prosequi.
• Jerry Joe Holcombe, possession of a controlled substance and DUI: two years confinement, 13 years probation, 40 hours of community service and $2, 250 fine.
• Franklin Eugene Johnson, family violence battery: one year confinement, four years probation, no violent contact with victim, restitution and $1,000 fine.
Terroristic threats: five years probation, no violent contact with victim and $1,000 fine. Third degree cruelty to children, additional count of family violence battery and two counts criminal trespass: nolle prosequi.
• Jesse Michael Masters, interference with government property, obstruction, disorderly conduct and public drunkenness: two years confinement, three years probation, $150 restitution and $1,000 fine. Criminal damage to property: nolle prosequi.
• James Kelly, family violence battery: one year confinement suspended upon completion of Residential Substance Abuse Treatment (RSAT), four years probation, no contact with victim and $1,000 fine.
• William Charles Paulies, theft by receiving stolen property motor vehicle: five years probation, 100 hours of community service and $500 fine.
• Larry Travis, VGCSA Oxycodone: first offender treatment, three years confinement suspended, seven years probation and $2,500 fine. Terroristic threats: first offender treatment, three months confinement, four years and nine months probation, no contact with victim and $1,500 fine.
• Bethel Renee Stiltner a.k.a. Bethel Renee Calloway, first degree forgery: 30 days confinement, nine years and 11 months probation, no contact with victim, restitution and $1,000 fine. Obstruction of an officer and giving false name and information to a law enforcement officer: 30 days confinement, one year probation and $1,000 fine.
• Willie Norris McDowell, theft by taking motor vehicle: two years confinement suspended upon 12 months at detention center followed by successfully completing RSAT, restitution and $1,000 fine. Theft by taking: nolle prosequi.
• Brandon Allen, sale of marijuana and possession of a controlled substance: one year confinement, nine years probation and $2,500 fine. Marijuana possession less than one ounce and giving false information to law enforcement officer: two years probation and $600 fine. Possession of marijuana with intent to distribute, inmate possession of drugs and possession of less than one ounce of marijuana: nolle prosequi.
• Tara Lynn Zagorski, possession of a controlled substance and attempt to obtain a controlled substance by fraud: two years suspended upon completion of six months IPS (intensive probation supervision), eight years probation and $2,000 fine.
• Gina Marie Williams, two counts criminal trespass: one year probation and $1,000 fine. Burglary: nolle prosequi.
• Jasmine B. Austion, DUI, weaving over roadway, hit and run and driving without a license: Four years probation less 24 hours confinement, 40 hours community service and $1,750 fine.
• Felix Montez Kemp, loitering and prowling and obstruction of a law enforcement officer: two year probation less 17 days confinement, no contact with victim and $1,000 fine.
• Keith Dewayne Barnes, party to the crime of theft by receiving: 60 days confinement, ten months probation, no contact with victim and $500 fine.
• Marlon Terrell Henry, theft by shoplifting: one year probation less 50 days confinement and $500 fine. Additional count of theft by shoplifting and battery: two years probation less 50 days confinement, no contact with victim and $1,000 fine.
• Timothy Bridges, battery and theft by taking: two years probation less 60 days confinement, no contact with victim and $1,000 fine.
• Jonathan Bridges, battery and theft by taking: two years probation less 60 days confinement, no contact with victim and $1,000 fine.
• Robert Lewis Taylor, battery: one year probation less 60 days confinement, no contact with victim and $300 fine.
• Chad Christopher Greel, family violence battery and criminal trespass: two years probation less 60 days confinement, no violent contact with victim and $1,250 fine. False imprisonment and violation of a family violence order: nolle prosequi.
• Antrice Gwenyedda Hill, stalking: one year probation, no violent contact with victim and $500 fine. Family violence simple battery: one year probation, no violent contact with victim and $500 fine.
• Amy Renee Martin a.k.a. Amy Renee Taylor, financial transaction card fraud: two months confinement, one year and ten months probation, no contact with victim, restitution and $1,000 fine. Theft by taking: nolle prosequi.
• Jacob Larry Powell, theft by receiving stolen property: five years probation and $1,000 fine.
The following sentences were issued as part of negotiated plea agreements on November 9, 2009 with Superior Court Judge Currie Mingledorff presiding:
• Tammy Rena Sears, first degree forgery: ten years probation, restitution and $1,000 fine.
• Adrian L. Rhodes, theft by shoplifting and simple battery: one year probation less 60 days confinement and $1,000 fine.
• Rigoberto Ponce Villagomez a.k.a. Miguel A. Hernandez-Vasquez, theft by shoplifting: 30 days confinement, 11 months probation and $1,000 fine.
• Jason Armand Hadley, criminal trespass and public drunkenness: one year probation and $500 fine. Additional count of criminal trespass: 12 months RSAT suspended upon placement in inpatient treatment. Disorderly conduct, public drunkenness and criminal trespass: three years probation, 100 hours of community service and $1,000 fine.
• Shemeika S. Smith, criminal attempt to commit theft by shoplifting: five years probation and $1,000 fine. Theft by shoplifting: nolle prosequi.
The following sentences were issued as part of negotiated plea agreements on November 12, 2009 with Superior Court Judge T. Penn McWhorter presiding:
• Larry Grant Wright, violation of domestic violence order: 12 months confinement and no contact with victim.
• Samuel A. Savage, DUI less safe: 12 months probation, 40 hours community service and $850 fine. Hit and run and failure to maintain lane: nolle prosequi.
• Ricky Harold Martin, family violence battery and simple battery: 60 days confinement, two years and ten months probation, no contact with victim and $2,250 fine.
• John Henry Hopkins, pandering: 12 months probation and $500 fine.
• John Gerard Petrucelli, obstruction of a law enforcement officer: 12 months probation and $750 fine.
• Quincy Smith, criminal trespass: 12 months probation and $500 fine. Party to the crime of battery and affray: nolle prosequi.
• Wesley Evans, DUI per se: 12 months probation less 72 hours confinement, 240 hours of community service and $1,000 fine. DUI less safe and failure to maintain lane: nolle prosequi.
• Stephanie Leann Eaves, battery: 12 months probation, no violent contact with victim and $300 fine.
• Donna Elaine McDaniel, disorderly conduct and battery: 12 months probation, no violent contact with victim and $500 fine.
• Bryan Eric Rickert, family violence battery, 12 months probation, no violent contact with victim and $500 fine.
