Sentences issued in Superior Court
The Barrow County Superior Court sentenced 25 people during the past week. Those charged and their sentences are listed below. Charges listed as nolle prosequi are those in which the prosecutor or plaintiff indicated they would not proceed with the case. In criminal cases, a disposition of nolle prosequi may be entered when evidence proves innocence or charges cannot otherwise be proved.
The following sentences were issued as part of negotiated plea agreements:
• Timothy Randall Johnson, two counts of third degree cruelty to children: nolle prosequi. Family violence battery and simple battery: 12 months probation. Aggravated battery, criminal damage to property, two counts cruelty to children and obstruction of a law enforcement officer: 15 years probation, no contact with victim and $2,500 fine.
• Cleo Warren Moore II, DUI less safe: negotiated plea to lesser offense of reckless driving, sentenced to 12 months probation and $750 fine.
• David Shamar Burgess, Reckless driving: 12 months probation and $750 fine.
• Chris Michael Jones, DUI less safe, two counts reckless conduct: nolle prosequi. Discharging a firearm while under the influence and driving while license suspended: 12 months probation, 40 hours community service and $2,000 fine. Discharge of firearms near a public street: 12 months probation and $1,000 fine. Obstruction of a law enforcement officer, speeding, failure to stop for stop sign, two counts of failure to maintain lane, two counts failure to use turn signal, open container, windshield violation and reckless driving: nolle prosequi. Fleeing and attempting to elude a law enforcement officer and suspended license: 30 days confinement, 11 months probation and $2,000 fine. Suspended license and failure to obey traffic control device: 12 months probation and $2,000 fine.
• Forest Fleck, VGCSA: three years imprisonment, seven years probation and $2,500 fine.
• James Russell Hunter, criminal trespass: nolle prosequi. Disorderly conduct: 12 months probation and $1,000 fine.
• Jason Damon Jarrell, aggravated assault and three counts cruelty to children: nolle prosequi. Family violence battery and three counts cruelty to children third degree: 12 months probation, no violent contact with victim and $2,000 fine.
• Tetrick Omar Thomas, theft: nolle prosequi. Theft by receiving stolen property: 12 months probation, restitution and $300 fine. Terroristic threats: pled guilty to lesser offense of disorderly conduct, sentenced to 12 months probation and $500 fine. Pointing a pistol at another: 12 months probation and $500 fine.
• Anthony C. Wuschula, possession of less than one ounce of marijuana: 12 months confinement.
• Rex Franklin Casper, child abandonment: 12 months probation and requirement to pay child support.
• Jeremy David Jackson, tag light violation and failure to yield right of way: nolle prosequi. Driving while license suspended and obstruction of a law enforcement officer: 12 months probation and $1,250 fine.
• Tamika Desiree Hicks, giving false name to law enforcement officer: 12 months probation and $500 fine.
• Randy Gilbert Burton, two counts battery and three counts of third degree cruelty to children: four years probation, no violent contact with victim and $1,500 fine.
• Brannon Harold Griffin a.k.a. Brandon Griffin, battery: 12 months probation, no contact with victim and $300 fine.
• Mike Anthony, abandonment of dependent child: 12 months probation and child support.
• Randy Hockman, aggressive driving: 12 months probation, no contact with victim and $300 fine. Battery and simple battery: nolle prosequi. Family violence battery: 12 months probation, no violent contact with victim and $500 fine.
• Joseph Mason Thompson, battery: nolle prosequi. Criminal trespass and battery: 12 months probation, no violent contact with victim and $800. Family violence battery and criminal trespass: nolle prosequi. Additional counts of family violence battery and criminal trespass: two years probation, no violent contact with victim and $500 fine.
• Lauren Lee Devault, DUI, improper tag and failure to stop for stop sign: nolle prosequi. DUI less safe: 12 months probation, 40 hours community service and $750 fine.
• James Harris Kindon, DUI less safe: nolle prosequi. Duty upon striking fixed object, no license on person and criminal trespass: 12 months probation and $1,000 fine. Improper backing: nolle prosequi. Additional charge of DUI less safe: 12 months probation, 40 hours community service and $750 fine.
• Gary D. Ledbetter, DUI and failure to maintain lane: nolle prosequi. DUI less safe: 12 months probation, 40 hours community service and $750 fine.
• Richard Luong, DUI and driving while license suspended: nolle prosequi. Second count of DUI and failure to maintain lane: two years probation, 40 hours community service and $1,050 fine.
• Denphong Danny Soukdhaysong, speeding: nolle prosequi. DUI less safe: 12 months probation less 72 hours jail, 240 hours of community service and $850 fine.
• Dennis Bryant Sayers, DUI and speeding: nolle prosequi. DUI less safe: 12 months probation, 40 hours community service and $750 fine.
• Amanda Elyse Kiser, DUI: plead to lesser offense of DUI less safe, sentenced to 12 months probation, 40 hours community service and $750 fine.
• Toby Allen Miller, failure to stop at stop sign: nolle prosequi. DUI less safe: plead to lesser offense of reckless driving, sentenced to 12 months probation, 40 hours of community service and $1,000 fine.
